Go to the US while K1 is processing/Temporary 90 day work authorization

Hi all!

My fiancee sent the I-129f on 03/18/2010 and I will go to visit her (to give her the ring!) next week. I have a round trip ticket... I read somewhere that I will have to tell the immigration officer we asked for a K1 visa... Do I have to since it hasn't (and it won't be) been appoved by the USCIS yet?? What if I want to go back later (maybe in June)??

Other question > I read in the VJ K1 guide that: "Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for". Someone can give me more information abt it?? (do I have to ask prior entering the US? Do I just have to ask the immigration officer?). I will live in NY (Poughkeepsie) and I usually flight to JFK.

That information is OLD. About a year ago they rewrote the rules about authorization for work and the K1 and stamp does not qualify. You need an EAD document if you enter on a K1. However one on a K1 cost $340 and take 60 days so at most you get 30 days work for $340. Not worth it. If working is an issue marry quickly and file AOS as the EAD is free then. As far as telling about the filing NEVER lie to an immigration official. They may already know from their computers and lying can cause you trouble for misrespresentation

This will not be over quickly. You will not enjoy this.

nope, because you are entering as visitor or tourist. When you have your K1 visa in hand you'll have to tell the immigration officer about it

About my visit in the US. Can my entrance be denied?? Do I have to provide proofs to the immigration officer to proove I won't try to stay in the US? I'm not renting a flat/house anymore but I m still working in France.

Yes you can be denied.

Yes, there are things you can bring to make it more likely that you'll get through immigration.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Depends on how long your visit is. A week isn't going to give you much trouble, but anything approaching a month and longer will involve a more in-depth interview. If you're going to be staying that long, they'll want to see that you are going to return to your country within a legal amount of time.

A letter from your employer stating that they're expecting you back on a certain date is a very good thing to have, and probably the easiest to get.

  • 09/28/2010 - Returned with police cert

As with any visa(VWP), upon attempting to enter the US, CBP can deny entry. It's up to you to show non-immigrant intent. (as outlined above).

Strong ties is what they are looking for.

Umit came to visit during our K-1 and she was given 6 months to visit, your mileage may vary. (she even told them that she was visiting her fiance and that the K-1 visa was in process)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

if asked about the reason for your trip, just tell the truth

if asked about petition applications, tell them about your a29f as well

but never ask about work authorizations while at the POE because that will defunitely create

suspicions about your real/other intent for visiting.

remember you're a tourist and are not allowed to work/study while visiting/"touring" :)

Just wanted to thank you for this comment, which helped me out also. I didn't know this information was out of date and that work authorization only costs money if not with AOS. AP, apparently, is the same deal.
