Great! I was able to collect everything tonight. I am ready to mail them tomorrow via USPS expressmail so that it will get there before march 29. Still debating though weather we'll pay the fee through money order or check. Coz our new checks hasn't arrive yet. The one that we have rightnow doesn't have both of our names on it. Anyway, here is my question. Does anyone of you applied for AOS on an expired visa or I-94? My I-94 is already 1 year expired. I don't know how this application is going to be. I wanna hear stories. It's pretty interesting. I am just praying that GOd will work on this papers....

first off, the payment doesn't have to be in both your names. whoever has the money can pay for it.

second, don't worry about the expired 1-94. the expiration applies if you did not do the requirement of getting married w/in the 90days, which you did.

just make sure the other req docs are complete and you should be ok.

and yes pray a lot and God will help you through it :)

Don't worry about the expired I-94. We applied for AOS almost two years after mine had expired and I we didn't have any problems. Our case was approved in two months.

22 Feb 08 - Moscow Interview! (APPROVED!!!)..Yay!

24 Mar 08 - Sasha and Jason reunite in the U.S. :)

29 Dec 08- Alexander is born

11 Jan 10 - AOS / AP / EAD package sent

19 Jan 10 - AOS NOA1 / AP NOA1 / EAD NOA1

08 Feb 10 - AOS case transferred to CSC

I agree mine was a year out of date when we filed. We didn't have any problems with the AOS process either.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

This is completely :ot:....but I just wanted to tell you that I think your pictures are adorable :-)

P.S. My husband's I-94 was expired several months before we applied for AOS and we got our GC fairly quickly as well.

We met in October 2007 and our immigration journey started in July 2008 when we filed for the I-129F Fiance Visa petition.

OP: The other posters were lucky. File for AOS as the highest priority. You do NOT want to risk encountering any Federal agent if you're out of status.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I just noticed that you were planning to send by express mail.

I was looking at the instructions and there is a different address for express mail and private couriers than if you send by regular USPS service.

Just thought I'n mention it since someone just recently had theirs returned for sending to the incorrect address.

We too will be filing after I-94 expires but only by a few weeks. Planning on filing end of April.
