My son was not born in marriage. There is no mentioning of biological father of my son in any of the documents. My son has my last name. In birth certificate in the line of Father is the name of my dad. (in my country if we don't want to mention who is the father, authorities automatically put my dad's name). So, the question, will Embassy ask for any documents from/about bio father of my son?

18th March 2010- Application is accepted

23rd March 2010- Touched....

30th September 2010- Approved at USCIS Vermont

5th October 2010- Case was received at NVC

7th October 2010- Hard Copy NOA2

28th October 2010- Embassy received our case (US Embassy in Bangkok)

5th November 2010- Got Packet 3 from the Embassy

uhmm.. as what i most read here, if the child was born outside marriage then u have the full custody of the child so the embassy might not ask about it... maybe they will ask a little but just tell the truth and i think u will be fine... :thumbs:B-)

I'd ask in the regional forum about the Uzbekistan consulate.

I would guess the consulate there is familiar with this situation, and why your dad's name appears as the "father".

Is your dad considered a legal guardian because his name appears? Just to cover all bases, I'd have your dad write a letter granting permission for your son to emigrate to the US. That way, if they DO ask for that, you have it all ready to go.

But I think you'll be fine.

Who would they ask for permission from if the child's father is not listed on the birth certificate and therefore is legally UNKNOWN!

Payxiba, I think you miss the answer on this one. Look at the OP's statement again, the OP stated that the child was

born out of wedlock- that's okay

the birth father name was not listed on the BC - that's okay

But instead of "unknown" or left Blank, it has her father's name, the child's maternal granfathers name listed - now this is a red flag

So everyone wants to ask why,

This same name could be listed on the OP's BC as her birth father

It's probably listed on the 1-129 and G235 form as her father name as well,

Someone is going to question why are the names the on the child's BC,the mother's BC and the official submitted document the same, because there is a name listed on the BC they will require a document from the listed Birth father on the BC giving permission to allow the child to leave the country. As I seees it if the listed name Birth father/GrandFather creat this document as if he is the true birth father, then they could be treading into dangerous water. i.e misrepresentative, fraud, lying.

The OP does have a right to be concern, but to what degree I don't know the answer to this, it could be that the embassy in that part of the country see's this all the time and don't question it. Or it could be that this could creat a RFE for the OP.

I would suggest that they talk to an immagration lawyer who lives in her country to see if this is anything to be alarmed about.

I will actually be taking care of everything in US Consulate in Bangkok, since I live and work here for 2 years.

My dad passed away 10 years ago. It is just this stupid law not to leave the space blank where is "Father" line. Thank you so much for your input!

Thank you so much for your help! :) We have actually a lawyer and I told him about this, when originally sent notarized BC of my son for K1 and he didn't say anything. But I guess, maybe it will be a good idea to ask Consulate itself?

Yes, true. My ex doesn't have absolutely any legal documents about my son. Truth kinda bites about my ex, but, if they ask I will tell them the truth. :) Thank you so much for your help!

This response is correct for Manila but virtually nowhere else. Child custody and permission issues require country specific answers.

Facts are cheap...knowing how to use them is precious...
