We are sending in our information for my husbands 10 yr green card. Just got the babys birth certificate in the mail this morning and noticed that my husband's middle name was spelled incorrectly with one letter.

My question is is this a big deal. I plan to still send it in but in the meantime get it corrected with vital statistics.

Hoping that the rest of our documentation will be sufficient enough. So tedious..

I doubt it is going to grab any attention from USCIS. If I were sending it in, I wouldn't even mention it. Just as you said, get it corrected in the meantime.

Okay so you're doing ROC, the birth certificate is proof of real relationship right?

If it's time sensitive I would send in the incorrect one BUT I would submit it with the document you sent off to get it fixed so they know you're getting it fixed.

You're knowingly submitting incorrect documents and I would hate a material misrepresentation to get him a lifetime ban. You should DEFINITELY submit evidence that you're getting it fixed otherwise it looks bad. I wouldn't risk NOT telling them.

I sincerely doubt the gov't would give a lifetime ban for a baby's birth certificate that has the father's middle name mispelled by 1 letter...c'mon.

I agree with v333k - send it in - you could add a note about the mispelling and how you're getting it corrected if you wanted.

I don't mean to freak you out--actually, a guy named Stephen was banned for lifetime for spelling his name as Steven. Or maybe it was the other way around. So yes, it does happen.

Yes - but the husband is apply for ROC (not the baby) - he has a GC and his form which has the name spelled correctly...the baby's birth cert is only 1 amongst a bunch of supporting evidence...and it's the middle name.....adding a note should suffice saying they're sending it back because they noticed a mispelling

I've bolded you repeating what I said so I don't understand why you're all "it's not a lifetime ban" just that if THEY decide you're being misleading then it's a lifetime ban. No-one SAID that in his particular case it would happen but I DID say that it's better that she DOES include the proof she's getting it changed so there's absolutely NO DOUBT that she's being honest.

No-one said it WOULD happen but she is KNOWINGLY submitting an incorrect document. They could decide that it's fake and that she deliberately tried to mislead the US government, esp if later she sends it in for something else and they're like "hey, that's different to the one she sent us last". Again, not saying it WILL happen but... misleading info is misleading info, and lying is lying. Big lie or little lie so, like I said, send it in BUT include the proof that you're in the middle of getting it fixed. Better to be safe than sorry.
