Hi,

My husband who is a USC has just added me to his bank account, but my maiden name and not my married name is listed on his bank account. I will be filing all my AOS forms in my maiden name. Will it be a problem if I show the bank statement with my maiden name, as proof of mingling financial resources?

Also, he just added me to one of his bank accounts that he doesn't keep much money in, just a few hundred dollars. Is it required to have a good balance in that account?

Any help will be appreciated....

AOS timeline:

1st March 2010 - AOS packet received at Chicago (I-130, I-485, I-131, I-765)
9th March 2010 - Checks cashed
12th March 2010 - All 4 NOA's received
19th March 2010 - Applications touched biggrin.png
19th March 2010 - Received Biometrics letter for 2nd April
2nd April 2010 - Biometrics done
19th April 2010 - Received interview letter for May 21st biggrin.png

Adding your name to an account that doesn't have any activity along with a small balance isn't really a strong piece of evidence.

What you want to show is a comingling of your lives that is typical for a married couple. That can be bank accounts, credit accounts, dwelling lease, health insurance, memberships, utility bills, auto insurance, auto registration, mail addressed to the both of you, driver's license/ID showing the same address, etc.

You ought to file in your current legal name. Having some things in your maiden name should not be a problem.

As long as you are both on the account there should be no problem, you would just bring something that shows both of your names. I don't think its required that there is any specific balance, more that you show that you have joint things.

If you have taken his name as your married name, is there a reason you aren't filing with it for your AOS? Its easier to file for it now than to get it changed later.

I forgot to add as well, if you want your info to show up in your married name (say on the bank account) you should be able to get it changed by showing them a copy of the marriage certificate.

If you have decided to take on his name (or a variation) following your marriage then your AOS paperwork should be completed with that name, and fill your maiden name in the "prior names" section of the form. If you complete the form using the maiden name, your GC will arrive in your maiden name and if you wish to change it to your married name you will need to pay the almost $300 fee for a replacement card.

Your marriage certificate serves as proof of name change so having documents in your maiden name (like bank account) doesn't matter. If you wish to change the bank account to married name they should accept the marriage certificate to change it.

As for balance mattering, no it doesn't. It just matters that you show "co-mingling". So all good :)

My marriage certificate doesn't mention my married name on it, since apparently thats the policy in Nevada. Will they still put my married name if I show my marriage certificate?

They should, if not you should be able to get your SSN updated to your married name and use that to show you are changing your name. You can then use this to get your state ID updated to your new name, as well as the bank account.

Thanks... what if I just send in the joint account statement with my maiden name on it? I'm not sure I will have time to update the bank account with my married name, so would I face some problem if I send in the bank statement with my maiden name on it?

You dont send in this stuff for AOS, you save it for the interview if you get one. The actual AOS package is just the forms and evidence for them (our I-94, marriage cert etc). Proof of anything else will be shown to the consular officer should you get an interview. If you cant get it changed in time for the interview I wouldnt worry, like I said the more important thing is you are both on the account, you can explain to the officer that you are changing over your info still if some of it is still in your maiden name.

I don't believe the 485 requires any proof of relationship, other than the marriage certificate.

I don't believe the 485 requires any proof of relationship, other than the marriage certificate.

I will be filing my I-130 concurrently with I-485 and its my understanding that proof of a bonafide marriage needs to be sent in when I send in the package. Sorry for not clarifying that it was for I-130.

When you're interviewed, you can provide evidence of the joint checking account if needed. It's not essential with the I-130 so long as you have other evidence such as the marriage certificate to send, since the I-130 is merely a petition. That and hte AOS are ajudicated at the same time, not separately.
