My Fiance child was denied a Visa because of lack of documents.

Does anyone know what documents are needed for the son on a K1 Visa? Also what medical documents are needed for the child? The child is under 6.

I checked everywhere on the site but found nothing?

All my Fiance documents are good, but they said the son requires more documentation. My Fiance was not sure which documents.

Could anyone please help?

Denied and asked for more documentation are two different things. The Embassy/Consulate would have given the foreign beneficiary a description of what they need (usually in writing).

** Topic is interview-related and may be more appropriate in "US Embassy/Consulate Discussion"; moving thread there.

Please fill out your timeline and profile. Document requirements vary from country to country.

Yes a six year old will need to have the medical exam and vaccinations.

You will also have to prove that the child is the son/daughter of the K-1 beneficiary, birth certificate usually does this.

Finally you will need to prove that the child can immigrate to the US, either demonstrating the K-1 beneficiary has sole custody of the child (no other person with parental rights) or a signed affidavit from the child's other biological parent granting consent for the child to immigrate.

A

Actually we had the birth certificate. We had the original and the translated birth certificate. They were notarized.

You've not mentioned the child's biological father? Where is he in the picture?

I know that I'll need a letter from my daughter's father, stating that he agrees for me to take her to permanently reside in the United States.

If he's not on the scene, then this needs to be proved. It may mean that she'll need to go to court to be formally granted sole custody. She might need to prove that he hasn't contributed to the child's support financially, if he hasn't. Is he named on her birth certificate?

The CO should have told your fiancee what more is required, just 'more documents' isn't any help to either of you. And I imagine with recent child custody issues between the US and Brazil, they're going to be sh!t hot on getting it right.

Yes my fiance has gotten written documentation from the child's biological father stating that he can leave the country with her.

I will try to ask her again if they specifically said which documents. She was vague and that I should speak with a lawyer to find out the documents needed for a child.

Document requirements for K-2 Visa:

The documents to be submitted for applying for K2 visa are same as that for a K1 visa. While filing the application for K-2 visa, the applicant should submit the following documents-

•A valid passport (not needed if child is under 16);

•Two completed DS-156 (non-immigrant visa application) forms.

•Two completed DS-3052 Supplemental Application Forms.

•Two recent color photographs (taken not more than six months prior to the application);

•A medical examination report;

•Permission to travel from other parent;

•A copy of the child's official birth certificate issued by the Registrar of Births. The birth certificate of the child should disclose the date/place of birth and names of his/her parents;

•Evidence of relationship such as letters, photographs which demonstrates that you have a legitimate relationship with the person who has petitioned for you;

•Evidence of support which demonstrates that you or your children will not become a public charge in the United States. Submit a completed Form I-134 (Affidavit of Support) to prove that your sponsor has sufficient financial resources;

•Evidence of termination of prior marriage such as death certificate, divorce decree;

•Military record: you must obtain your record of military service, if applicable and obtainable;

•Police certificate: police certificates are required for every applicant aged 16 or over

•Bank draft for visa fee.

Really? I highly doubt that a Passport isn't needed for children under 16. International travel requires a Passport not to mention where the heck will they affix the Visa?

This is specific to the country where the visa is being issued. In some countries, children don't get passports. They travel on their parent's passport, which naturally means the child cannot travel without the parent. In this case, there may be a "travel pass" for the children attached to the parent's passport. Visas for the children are affixed to the parent's passport.
