Card expired, trip planned, no NOA, what to do?

Hey all!

We have a trip planned to the UK in February (changeable plane tickets, but we'd rather not have to!). We filed early this month with VSC, thinking we'd have a NOA1 in hand shortly. Our check has been cashed but the case number on it brings up nothing in the USCIS system (though I've read that's not unusual). Yet another day has gone by and we're just over three weeks out from our trip. His card expires today.

What, in this case, should we be doing? I'm assuming he can't travel on the expired card without the NOA in hand, or can he? Is there something he can get at an Infopass appointment to confirm his status in the US?

You should receive your NOA1 by then. Sometimes it takes a little longer than expected.

An infopass may be a good idea, I am sure they can pull up his record and see that you already applied for ROC and possibly receive an I-551 stamp in his passport which is a 1 year extension. You can schedule the appointment and if you receive your NOA then you can cancel it or get the stamp and that way he doesn't need to carry the letter everywhere.

Yes, schedule an infopass at your local USCIS office. You can do that by going to the USCIS website ( http://www.uscis.gov ) and selecting Make an Appointment/Infopass from the lower left hand corner.

Bring along the proof of your travel dates and your expired green card. They will access his file through the A number, verify that you have submitted the I-751 (you can bring along a copy of the cancelled cheque as well, if you like) and stamp his passport with the I-551 stamp for a specified period of time, usually one year.

The NOA normally arrives within 2 to 3 weeks of submission but there have been cases where it was delayed and last year at about this time where none were sent out at all. I never received an NOA for my ROC application so had to get my passport stamped as well.

Make your appointment for at least a week before your scheduled flight just in case you do receive the NOA, in which case you can cancel the Infopass. Good luck.

Thanks, everyone. :) I'm just being paranoid, I know, since a few people who sent in their packages a week after me have gotten NOAs and we're still waiting! I'll have him do an InfoPass appointment. It's good to know we have options.

I guess it depands where you live sometimes Vt takes a bit longer ,

but also remember you probly going to get a biometric apt notice

(biometrics is set usualy about a month after you filled )

I've heard that this January USCIS got so many applications, and with all holidays, they are a little (more) behind. they should be able to pull your record at the infopass, also if I were you I will take proof that they cash out your check; let us know what happen.

Aargh. We've got our biometrics notice but still no NOA!

Gwen,

Don't worry, it's great that you received the biometrics notice. In my opinion, it is far more important than NOA1 because NOA1 can be replaced simply with a stamp. But your biometrics, if missed, is a guaranteed denial for your application. Try to get a walk-in biometrics appointment and get it out o the way (unless your given appointment fits well with your travel plans) and, while at the immigration office, get a stamp on your passport. Make sure you take your biometrics letter with you when you go overseas as a proof for filing I-751 (since you dont have NOA1) just as a backup. I I truly wish you the best :)

I intend to travel overseas in March. And if my biometrics are not done by then, I'm cancelling my trip with no second thoughts :blink:
