OK Here is the deal. my fiancee has her interview date for her k1 visa for the 27th of next month. but i just got laid off but with a return to work date. or lack of work. so should i be worried is this gonna matter. will they even look. my work has alrdy sent all the info of how long i have worked there. so should i be freaking out?

No. Don't worry. Your I-129F affidavit has already been accepted. Your next step will be the AOS I-864 when she's here and you're married. But don't worry about it for now.

I agree, you should be okay for now. Your biggest problem is finding work and surviving in these tough times. Hang in there, don't give up trying and looking and you will be successful.

I don't understand this response. The affidavit of support is submitted at the interview, and not with the I-129F. If the consulate finds out he's not currently working, either because the documents submitted indicate this, or because they ask his fiancee at the interview, then I would think it would be a show stopper.

I don't understand this response. The affidavit of support is submitted at the interview, and not with the I-129F. If the consulate finds out he's not currently working, either because the documents submitted indicate this, or because they ask his fiancee at the interview, then I would think it would be a show stopper.

My K1 was not asked during the VISA interview if I was employed. They asked her if she knew what I did for a living and the company name.

I dont know if you're interviewing in Vancouver or Montreal, but my fiance was asked where he worked when he was with me at the interview. They might ask your fiancee where you work during the interview.

Well i still have a job. im just laid off for lack of work. i guess kinda like season worked.

Granted, being laid off is not the same as being fired. You may have a job waiting for you if your employer calls you back to work, but you're technically unemployed until then.

My K1 was not asked during the VISA interview if I was employed. They asked her if she knew what I did for a living and the company name.

Mine wasn't asked either, but I provided a lot of evidence that I WAS currently employed with my I-134. If I had been laid off between the time I got my letter of employment and the interview, and if my fiancee WAS asked if I was working, she would have had to answer "no". At the consulate she interviewed at, that would have been the end of the interview.

Whoa! back the truck up.....

Guiltarlo, please be careful with the advice you are giving others here, although your intent I'm sure is good, this advice could potential create more problems down the road for the op.

1-134 and I-129F have nothing to do with each other as far as K-1 petitioning is concerned until it reaches the embassy, no affidavits have been looked at or approved until it is sent to the embassy after NoA2 approval or the beneficiary takes it to the embassy come interview day. I-134 may or may not be asked for at the interview (In my case it was). And if the C/O wants to see it, you best have it or face delays at the embassy level. So even this is not a "Required form" I would play it safe and have it ready to go.

Not to say you should worry, but as Jim said, you may want to get a letter from your employer on a company letter head stating that you will return to work at a specific date. And that the nature of your work is full time and you make however much you make a year, despite your temporary time off.

I have to disagree with the post above. If you're laid off and collecting unemployment insurance the money is counted as income. It begs the question what's the difference between I-134 and I-864 when it comes to being employed. Ive read on VJ where the petitioner has been laid off after the K1 got the VISA, got married, filed for the I-485, I-864, went to the AOS interview unemployed and was approved. The question "what happens if I lose my job during the process?" comes up a lot. If there's a specific forum on it in VJ I would refer to it. If I was in your shoes and my K1 was having her VISA interview and I unexpectedly got a pink slip from my job I would tell her/him that if the CO asks where I work and what I did to stick to what I put on the petition and let it go at that. I have never heard of the Embassy during a K1 interview to re verify the employment status of the petitioner.

How long have you been researching? And you should defiantly site your sources.

How do you know that employment verification has never been looked into for AR at the embassy level. I would hazard to guess that they do in some cases. The C/O are the judge, jury and executioner when it comes to this. So I would be prepared with as much evidence that could be provided that you are still expected to work with a letter from the employer. If the C/O asks "where does your fiance work?" then put the case AR after the interview goes back and sees that the petitioner is in fact not working and the beneficiary could have known this before the interview the C/O may think A. They are both lying. B.The petitioner and beneficiary have no communication in this matter.

It won't kill the op to get a letter from the employer stating the nature of work (if seasonal) and when he is expected to be back to work. If you play coy or tell half truths you could be opening a bigger can of worms for yourself.

There is no reason to take chances. Do everything to ensure you have employment. Yes I think you should worry enough to do something about the situation instead of just letting things happen.

there are a huge group of us from Canada who had our interviews around the same time and i believe almost all of us were asked about our fiance(e)s work. that or they were asked directly if they attended.

i'm not sure what they do in situations like this, just be prepared. if they gave you a return to work date i would bring evidence of that just in case ( though i am paranoid) also you should be able to collect unemployment. My fiance was on unemployment at the time of the interview and they never said anything about that ( though his construction job is seasonal).

relax a little but be prepared. they always give a chance to explain yourself.
