Does anyone know of a statue of limitation regarding visa denials? Whereas, The Consulate denies a visa (same couple) began with K-1 – K-3 currently and being denied year after year after year. The interviewing spouse has a slight sensory (memory) problem but their love is strong and everlasting. They refuse to stop until united here. One works here and supports the other there. During interviews she forget simple, yet basic, important dates, places and times... which, again gets denied as a sham relationship.

He went back and married her four years ago thinking might improve their odds! lol!

Happy New Year!

My thought is to get a diagnosis of the condition and present that to the consulate.

There is no limit on how many times you can apply, but there is also no limit as to how many times they can deny. A doctor's cert would definitely be a good idea. Is there a possibility of the USC moving to the foreign spouses country for a few months years? That would help proving the bonafides of the relationship....

If they have been married for four years and he has been supporting her there should be plenty of paper evidence that they are married and it is a legitimate relationship. He needs to be there for the interview. It might be to the point that she is not even wanting to go because it has been a bad experience for her. If I was interviewing her I would wonder why if he already knows she has problems at the interview he is not there with her.

If this if for you, I am aghast, as I think , seriously, you would have known about this prior to the first interview, and absolutely gone to ACH at that embassy to talk with a VO about it, then learn about a Doctors Cert for this medical malady.

If this is not for you, but for 'a friend' - hey ... that's a medical condition - you really should find out if it's one that would prevent immigration or not.

If yer asking, for a hypothetical situation - hey - there's LOTS of places to ask - I suggest each Embassy's IV unit - then report back on VJ once you've gotten responses from 40 Embassy IV units.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
