I understand taking a bit of time... However, as momma would say... Ya cat move forward with yer bra on backwards... so girlie... Get your bra on right and yer busoms in line and start moving forward again...

Based on the facts presented you would not incur any ban since there was nothing withheld from the process... so eliminate that option...

Your current petition is based on a legal marriage and should be approved...

However, your story is a very unique one and I am sure triggered some red flags in Paris. I suppose that they wanted to take a bit of time to verify all of this and as we know, the US Govt is not exactly super quick on responding (I am sure this trend holds true for embassys with questions of the Govt)... So take a breath... Give them the benefit of the moment for them to verify your story and checklist... and EXPECT the best result... Expecting the worst sets the bar pretty low so be sure to be thinking that this is just a delay...

Firstly, I'm sorry it has taken me this long to post, Ive been num, and still not myself.

We interviewed, and both of us were grilled till well done on both sides, we were there for about 3 hours.

The wicked witch from Wizard Of Oz is alive and well and is the one who interviewed us.

Short story, No approval, No denial, and No AP/AR we are in limbo land. WW said they will call my husband

They do have my husbands passport, even when I asked the Wicked witch of the East, "Are you going to keep my husbands passport?" She replied, "Well we like to give them back since they need them" but she made no motion to hand it back to me or to him, they have it. I fly back to USA tomorrow, alone and broken hearted, not know when I will see my husband again, and our fate ahead of us. This process is heartbreaking, my heart can not take anymore.

I need some time, and will post with progress. I thank all of you VJer's for your kindness, love and support you have given us.

There is nothing left in me, but sadness , and emptyness.

So why did they keep it,? a visa coming soon? I dont know.

Thats right... Baby steps... Start to get that rational "we can conquer" this attitude back... dont let this defeat you. As an Algerian citizen he can always demand the passport back, but give them another day to confirm your story you presented to them and see if you cant just get the visa... It's not over... Get poistive and expect that the next time he sees that passport it will be with the visa in it!!! You'll get through this girl, I know it!

Im back in fighting mode, just consulted 3 attorneys, 2 out of 3 said same answer.

And I still trust of what first attorney told me, as long as I told USCIS everything of first petition, they can not deny this petition for reason why we withdrew the 1st petition nor the cirmstances of why we withdrew it. Past is the past, no criminal charges filed on me, nothing on record of bigamy!!!!!!!!!!!!!! Im clean as a fresh washed Wonder Bra, LOL

Okay Christeen, got the Victoria Secrets Wonder Bra on staight now, Love ya!!!!!!!!!!!!!!!!!!

Yes, I agree, BUT....... does the state dept. see notes , or comments in the computer written at the time of the interview in Paris??? I dont know, if I did , then maybe I could swallow the All looks good. UGH!!!!

Always friggin drama in this nightmare, rollercoaster, throw up process.

I talked to the State Department, explained all of it, interview, the questions, of them keeping a other nationals passport that was not a French issued passport, etc, etc. and that his French residency card was expiring Nov. 6th, blah, blah, etc, etc. I was told last thing by lady at State Dept. All looked good!!!

Why would she say that? do they have access to the Paris embassy computer system for our case? to see about our interview 4 business days ago?

DOS tele-operators see what the Embassy sees, but it's not 100 percent transparency. CaseFile notes , written by a VO, are usually are not viewable by a Tele-Operator. In some instances, the data is not updated instantly, as well, so it's possible that there is a 1 to 3 day lag of 'updated casefile status'.

What I find to be useful, though, is STATUS.

1. current status, with a date/time stamp and

2. last 3 status changes, with the date/time stamps.

Call twice a day, make copious notes on the status bits, and you should :

1. recognize a pattern after a few days and

2. understand any movements of status.

IMO, it's a PITA, as suddenly one has to be a 'verbal sleuth' when talking to a DOS tele-operator.

Hang in there. IMO, them keeping his passport is a good sign (as others have mentioned ) He's gonna have issues past the 6th, though, but I think he'll be OK with a USA Visa Stamp - he SHOULD BE ALLOWED to exit France without any untoward '#######' on his record in France.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The lady I talked to was a Visa Specialist, is that the same as a D of S opertor?

Leaving France we dont care, what will they do to him?, kick him out of France at airport, they will see he is leaving France, so that part dont worry us.
