applys 1 yr after 1-94 expire.is this gonna be a problem when i apply for the greencard?

is this gonna be a problem when we apply for the greencard?

plz help!

Timeline

Typically the overstay is forgiven when the AOS is granted.

She's been out of status for quite a long time. So just be careful that nothing happens to bring her to the attention of ICE or CBP.

If she leaves the US she won't be able to return with Advance Parole or the Green Card.

File as soon as you can. It's very unfair to your wife to be in this situation.

my wife came here last aug.

we got married after 2 days of her entry.

it took us a long time to get her SSN and gather the fund for the application fee.

now her 1-94 is alrdy expired for a long time.

we havent recieve any papers from the USIC yet.

is this gonna be a problem when we apply for the greencard?

plz help!

not really. many couples apply much later for so many reasons (ex. finances) just make sure you don't lose it.

I'm in the same situation, kinda. I was here for 6 months before I married my husband. And I have overstayed by 2.5 years (because of financial reasons). We are just about to file. I'm hoping we'll be ok and that I can explain clearly to USCIS why we could not file before.

Adjustment of Status

11/03/10 ------- AoS (I-130/I-485) Package mailed out (Priority Mail)

11/07/10 ------- AoS Package received and singed for

11/10/10 ------- NOA1 received for I-130, I-485 and I-765 (emails)

11/12/10 ------- NOA1 received for I-130, I-485 and I-765 (hard copies)

11/12/10 ------- Touches on I-130, I-485 and I-765

11/19/10 ------- Biometrics appointment letter received

12/06/10 ------- RFE for I-693 (I think the issue is that it was not signed. Called USCIS and will receive a letter in a few days explaining)

12/13/10 ------- Biometrics done

12/16/10 ------- EAD card in production (email)

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

Did you come on a K1 fiance visa?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Just to be clear? She's here on a K-1 Visa, right? Not a K-3 ??

You won't EVER receive papers from USCIS on either visa types - you , as the USC spouse, have to FILE something TO USCIS.

IE - You're not waiting on them, THEY are waiting on YOU ..

So, do an AOS packet (I-485, plus the EAD and AP - why not, they're FREE when sent in with the I-485 ).

Technically, she's not OUT of status, but she has no status, either.

She was to get married within 90 days of the POE date (the I-94 should reflect an expiration date 90 days after the POE ).

SO, as long as you two got married within 90 days, YOU SHOULD BE OK (unless you really botch up the paperwork for AOS ).

BE GOOD !

I find it hard to get my head around the mentality of people that do their sums and fall short the 1010 dollars, and think to themselves "Ah well, doesn't matter, I'll move country anyway!!"

What's wrong with people...? Save up ALL you need BEFORE even getting the Visa.

yea i agree, esp if you know finances are going to be tough, the sooner you can apply for AOS the sooner your now wife/husband can work and help support each other, get the money for the AOS as soon as you can from anyone you can!!!

No, I came as a visitor from Canada. Just fell in love and never left. :devil:
