Timeline
I know that everyone's heart is in the right place, but did anyone really read my two posts. If two people are not married at the time of the child's birth, and the child is not born in the USA, a blood test must be done. My wife and I brought in evidence of my citizenship, we had a declaration from the doctor with our child's picture, and we had his birth certificate. This simply is not enough evidence due to the amount of fraud that exists. These parents MUST submit to a DNA test, or the child will never be given its' citizenship in the United States. I cannot remember where this is written, but because I have a hard time believing the truth as I think it should be, I investigated this problem within the pages of USCIS, and DHS web sites. This is the law. I do not know if there are exceptions or not. I don't remember reading any. I would beging speaking to my congressional representative. By what I have read here in this VJ website, they have considerable pull when they start to make waves. Just make some waves.

Another thing, do not call 911. This is for emergencies only. It is not just a convenient venue for our use when it suits our needs.

One other thing, if you leave town, then your fiance can say that you abandoned her. Do not leave, but never be alon with her if she comes back. Perhaps start custody proceedings right away for your son through the courts. Him not having proof of citizenship may not matter. Just tell the truth.

Hello,

My fiancee just got here on a visa that expires in 90 days. It clearly states that she has to marry me within the 90 days or she has to go back home. We have a baby together, but she decided to leave us. She left with her uncle thinking she can become a permanent residence without me. Her uncle told me he'll hire a laywer to do the paper work for her to stay here as a permanent residence without me at all. I then asked him how is that possible sir? He said he can tell the laywer i abused h or threw her out of the house, therefore she has the right to report this and get permanent residency. I can't believed they would make up such a lie for her to stay. Is it true that she can stay in the US as a permanent without me? I thought she has to marry me within 90 days or she has to leave the US?? i am thinking to hired a lawyer but first i need your help

Protect yourself dude. Have you filed a report with your local Police Dept yet? Call 911
It's an excellent idea to file a report with the local police, but do NOT call 911 for this! Calling 911 is for life-threatening emergencies, and in fact you could get into unofficial or formal trouble for "abusing" the 911 line. Go down to the police station and see who is willing to take a report, or at least talk to you about the situation, and get a name, rank, & badge number. The police may not want to take a written report about anything that hasn't "happened" yet (accusations of abuse, etc.), but get it on record that you have at least spoken with someone specifically identifiable. Again, I'd call ICE first, for clarity and direction that could prove valuable and most efficient for you.

That's your opinion. I see it quite differently. OP has a domestic situation on his hands, it is time sensitive, there is a child involved. He has also been threatened by the Uncle. An emergency clearly exists.

I was not born in the USA. I am a USC, and I never went through DNA testing. I got my US passport in 08. They required my long form birth cert. My mothers(USC) birth cert. I got an RFE and had to add proof she was in the US for atleast 5 years(i think), proof I was in the US before I was 18. I could be off on these lenghs of time and age, but not by much, it has been a year since I did this.

Call the USCIS and report her and hire a family lawyer for custody. The child is an American and his mother is not American and she is two weeks from loosing her status. File for custody of the child and let ICE deal with the rest. worry about the child.Do not have contact with her.

I would like to thank everyone for the greatest advices. This lady will pay a price for turning her back on me thinking she can play the laws by listening to her uncle. I hope he puts lots of money out to hire some laywers thinking he can keep her here without me, then gets screwed at the end.

If she comes back crying and sad and telling you she made a mistake, you will know that she has realized her mistake. Don't fall for it. That's my advice.

I truly understand your hurt, rage, and fear. Please report her abandonment and their threats. The reason for calling 911 is to get a time stamp on the call and an incident report on file prior to any action the girl and Uncle may follow up with.

ICE takes calls 24 hours a day, let them know ASAP. You can always call ICE back later to update information on your report. Best to be pro-active and take copius notes on all details from here out. Make sure all Immigration documents, copies, photos, NOA's, etc are in a known safe place and preferably away from your home. If she wants to come collect her belongings, be sure she brings a police escort. I would avoid all contact, especially in person, they have threatened you with some very serious charges that could easily affect your freedom, employability, pocketbook, lost time from work, and your own emotional health.

A consultation with a local attorney practicing both Immigration and Family Law would be a wise decision.

Take care and protect yourself.

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

The best way for the OP is to leave well alone now, and if any contact is done, make sure it's done in public places where there are lots of people, and always have a friend or two with you in case of any trouble.

All excellent advise. I wish you the best and am sorry there are ppl in the world who are only worried about getting into the us.

1. Have nothing to do with this woman without witnesses present. If legal record all conversations including telephone conversations.

2. File for emergency custody of the child, the judge may deny it saying it's not a serious danger to the child but it will get the matter in court and perhaps you can convince him their is a real danger of her removing the child from the country and he can issue an Order that will prevent this. File said Order with the appropriate persons.

3. Do not, under any circumstances, allow this woman into your life. I don't know how she became pregnant but I am willing to bet it was an ooops. So when the child becomes of age he/she can file for his mother to come to the US.

4. Call ICE, DHS, and USCIS and inform them of what she did. Be prepared to provide specific details and addresses where she may be. She entered for the purpose of marrying you and she has now made it know she has no intention of doing that. FOLLOWUP these phone calls with letters.

5. Keep all documents and specific notes for not only family court but also for any investigation regarding her immigration/illegal status.

6. Inform the local police of what she has done and said and request a report be made and obtain a copy of such. She has threatened you with filing false reports against you regarding domestic violence. Explain the situation to the police and that you want some documentation that you have reported this threat in case she does follow through with it.

I know you are suffering a lot of emotional damage right now thanks to this witch. You must remain focused and set priorities. First should be the child, second protecting yourself from any false accusations, third having her removed from the country, fourth having her and her uncle prosecuted for immigration fraud.

Good luck and plz keep us posted. We are here for you for advice or just a shoulder to cry on or just for you to vent.

This person did not give a time line for the baby's birth. He did say that they had just arrived. The conclusion therefore is that the baby was not born here in the United States. Perhaps some clarification is in order. Where was the baby born?
