Just got a call from my congressman's office. They just received a response to their inquiry on my behalf. USCIS told them that the IMBRA RFE would not affect the processing time of our petition. When I got my NOA1 the processing time was stated as 80 to 110 days. I'm also a NSC transferree. So that means if they are correct I will get our NOA2 no later then 8/17/06. So we'll see. Of course now I need to get my RFE back in to them which should be in the next day or so. B)

I'm a transferee from NSC too but my NOA1 was March 6th and I'm still waiting. I'm already at 129 days and got the same 80-110 day estimate in the beginning.

i hope that's right Dean. my NOA1 is March 17 so would be receiving approval any time now, :D but not going to hold my breath. :unsure: wishing speedy approvals to everyone.

Heap another shovel full on that pile!!!! IMBRA has already added over 2 months to the process in my case - just the time it took to return the file from Paris, probably back to NVC, then to NSC where it was originally approved, then transferred to CSC, then wait around for the RFE, now wait around some more for them to look at those piddly 3 questions, only one of which I responded "no" to. So for something that has no bearing on my case, it has been delayed over 2 months. My fiance would have been here by now, settling in, and we could get on with our lives. It is inconceivable that this could be construed not to be a delay.

4/24/06 - fiance received instruction pkt (pkt 3)

5/05/06 - pkt 3 checklist returned to embassy

6/21/06 - 1-797s (2) received, petition "received", "reopened" by CSC

6/26/06 - email, RFE sent

7/05/06 - RFE received and sent back to CSC

7/06/06 - RFE received, signed for by receptionist at CSC

7/11/06 - email RFE received by CSC

7/12/06 - touched (same message as day before about RFE receipt

WAITING WAITING WAITING

8/15/06 - NVC receives reaffirmed petition (no written confirmation yet)

8/22/06 - NVC sends reapproved petition back to Paris CHOUETTE!!!!

I would have to thank Tahirih Justice Center for this, as they helped to write this confusing, overly vague law that has been almost impossible to implement. I just fired off another letter asking them to lend some help to unravel this visa fiasco that they helped to create in the first place.

I think, unfortunately, the congressman and senator information regarding processing time post IMBRA RFE return are only in reference to cases that were NOT recalled from the consulate abroad. My impression is this estimate of processing time only refers to cases that were sitting on hold at CSC while USCIS created the IMBRA RFE form. Since processing was complete for many of those cases, it make sense that they would not incur much more delay. (I am aware that common sense does not really come into play here).

Never hurts to hang on any shred of hope...

People get upset, though, when statements are made which seem definitive, and yet, there are many cases out there to prove the statements already false....

I truly hope so.

However, there has not been an NOA2 issued to any K-3 filer for their I-129 since 2 months ago. This, in fact, is a delay.
