Hi,

We are in the process of finalizing the I-130 process and await the NOA2 every day now. Now I got a very good opportunity to work outside of the US for 6 months or more, but I read that once my wife get the green card she can not leave the US more than 6 month without filing an exception, what will be tough, because we would file the exception right after we get the green card.

Now my question is if there is a way to hold the I-130 process for a year or so, because I do not want to cancel it. I read that canceling the I-130 has an effect on future I-130 filings and I don't want to mess it up.

You can stall it at the NVC stage.

Not sure if this is available at your Consulate/Embassy, but I was told by the Consulate Officer at my interview that they could delay issuance of the visa. All I had to do was send them my passport when I was ready to move.

I also delayed sending in my information to buy some time.

Your whole process at NVC could be held up to 1 year. You just have to speak with NVC to inform on how exactly. If I'm not mistaken, I believe it's up with the IV bill. If you don't pay it now but later in time... Also you'll earn up another few months while the whole process is over with the time to the interview. And the issued visa needs to be activated in 6 months after issuing. So, even if issued in Dec 2010, your wife can enter USA not later than June 2011... Good luck :thumbs:

Is your employment abroad with a US company? If so, your wife may be able to go with you, with the exception. They don;t care when you file it, be it the day you get the greencard or months/ years later.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

From what I understand, once your wife activates her visa by entering the country, she can leave again almost immediately. And she can stay out for months at a time. I think there is some limit, but I don't know what it is. I also know that she can get a special visa that used to be called a white passport that allows her to keep her greencard without actually living in the US, but I think it is harder to get since 9/11.

I've had several friends who have lived for years and years outside of the US and still maintain their greencards, but they had the "white passports" before 9/11.

AOS Timeline

4/14/10 - Packet received at Chicago Lockbox at 9:22 AM (Day 1)

4/24/10 - Received hardcopy NOAs (Day 10)

5/14/10 - Biometrics taken. (Day 31)

5/29/10 - Interview letter received 6/30 at 10:30 (Day 46)

6/30/10 - Interview: 10:30 (Day 77) APPROVED!!!

6/30/10 - EAD received in the mail

7/19/10 - GC in hand! (Day 96) .
