can i use copy of divorced decree for Packet 3 and interview date?

Hi

We already got noa2 and now prepare document for packet 3 and for interview date.

My boyfriend, he is US citizen and divorced. He already sent me his document

1. copy of passport

2. tax return 2008

3. w-2

4. letter of employment

5. copy of divorced decree

I want to make sure that can i use copy or i have to use original document.

I already told my boyfriend but he said, he don't think immigration need original document.

anybody know pls let me know

I just went to the US Embassy in Bangkok site and their Packet 3 Instructions clearly say:

The original documents must be presented at interview.

TERMINATION OF PREVIOUS MARRIAGES: If either Petitioner or Beneficiary was

previously married, please provide proof of termination of that marriage (e.g. death certificate

of spouse, final divorce decree or annulment).

So, according to the US Embassy, you will need his original divorce decree document.

On the issue of divorce decree(s)...........

If person has ben divorced 2x in the U.S. does one need only the most recent or all decrees.

For Example: Marriend in NY state, Divorced in NY state. Married in NY state 2nd time. Divorced in Oregon. Now living in another state.

If person has ben divorced 2x in the U.S. does one need only the most recent or all decrees.

For Example: Marriend in NY state, Divorced in NY state. Married in NY state 2nd time. Divorced in Oregon. Now living in another state.

I think you have to have all of them. So there is "proof" that you can legally marry again.

Theres usually only a very small fee to get an official copy if your trepadious about not having the original. I think it cost my fiance only 13 dollars.

maybe I am being narrow minded, but.....why would one need the 1st divorce if they had been married for a second time. Would not the fact that they got married in the U.S. for the 2nd time be evidence of the disolution of the 1st marriage?? Then of course one would need the 2nd divorce decree to demonstrate that thay can again get married.

What am I missing here?? Thanks

Copies of all divorce decrees. They are easy to obtain via phone and mail. Took me about a week to get both.

Your missing the fact that some people do lie and get married a second time without a divorce...not common but does happen. States generally have no way to check if you have been married before but the federal government can...do they, I doubt it but they want to make SURE you can get married to the foreign individual you are petitioning.

I see your point. Althought, with the way things are (very Orwelian), I fugured that one would be "bagged" if they tried it here in the US.

Makes me think that to get married in another country one would need either 50 states of certification of "no impediment" or one from the federal government.

If he submitted original at the time of petition, I don't see a problem if he uses copy the second time. See, they have already seen your original. I have seen people use copy and they have successfully passed your interview. The thing is you have to make sure you have submitted the original one the first time around.
