If you're not getting any response from USCIS ask your Senator's office to investigate for you and confirm that they received your withdrawal. I'm sorry that things didn't work out and hope life gets better for you soon.

Thanks for ur advice, i will call my Senator's Office, but is that the only way??

I'd suggest an infopass but you said you have already made numerous trips to USCIS without success so it doesn't appear that would be any more successful this time than previous times. Your Senator's office has staff who deal specifically with immigration and have 'behind the scenes' access routes they can use. You just need to confirm that the Affidavit of Support is withdrawn so you don't get surprised by your soon to be ex-wife's green card approval. I think you should be able to get confirmation of that and since you haven't by now, going the route of your Senator's office seems the logical next course. Besides, it was one of the things he/she was elected to do - represent your interests with the government. Good luck.

Exactly, I need to know that my I964 has been withdrawn because if for some reason it wasnt withdrawn she might get her green card ( without and interview of course, because if she needs an interview, i can obviusly tell my side of the story.) i will say that when i checked status on CRIS it says they sent her an RFE 3 weeks after i sent the withdrawl letter and until the status says "RFE Sent", so maybe she recieved her deportation papers. Also, last week we had a divorce date at the court but her immigration lawyer tried to extent the time we were together (before we seperated). I thought that was wierd. My lawyer didnt agree. This has been a nightmare. Any previous info or insight would be great

I just recieved a call from my senators office, no need to call uscis to withdraw my I864, My ex's I485 was denied almost 2 months ago and i never even knew. I guess she had it coming.

I wonder why her lawyer is trying to change the dates we lived together in the divorce settlements? He wants it to say we seperated 2 months after we actually did.I thought she had no way to adjust status except through me. This keeps getting more complex!

LOL!! that has to be it!! She has no green card, i dont know how she can adjust stautus, but the aide at the senators office told me to be very careful, that she sees alot of woman claiming abuse AFTER there cases have been denied. I told her itll be hard to claim abuse IF WE SEPERATED 5 DAYS AFTER USCIS RECIEVED HER I 485 PETITION. Does anyone know what her lawyer is trying to do,he adjourned todays hearing for a whole month, and still wants to extend the time our relationship lasted from 1 month to 3. HE WANTS TO LIE

I'm glad to know that the application was denied and you are off of the hook. The only reason I can think of her lawyer trying to get you to admit to a longer period together is that she may try for a VAWA claim and use that time in between when she really left to what the lawyer wants to state as a basis for any "abuse" that happened. Stick to your guns and don't let yourself get pressured into a lie. Good luck to you.

Exactly, but u know i will not allow her lawyer to put a lie in the divorce settelment, it just wont happen. Plus, can VAWA be claimed without police/medical records?? Also, we didnt even live with each other, i can family and neighbor testimonies about that

Good luck with your day in court. Try to stay focused and strong and also remember to read the divorce decree entirely and request changes as you see fit.

RFE received April 21,04 at NSC online

NOA2 received April 29th,04 via online

NVC receives file May 6th,04

NVC sends file to Nigeria May 11th,04

Lagos receives our file, notified thru e-mail May 19th,04

Victor goes and picks up packet #3....May 20th,04

Sent request for earlier interview date via e-mail May 20th,04

May 27th, Lagos won't change date.

August 16th, 2004 fly to Nigeria for Victors interview

August 19th, 2004 Interview date, visa approved.

August 25th, 2004 Victor picks up passport with visa stamp.

August 26th, 2004 fly back to USA

September 18th, 2004 Victor arrives in USA, Lord willing.

October 9th, 2004, we become husband and wife

October 25th, 2004 I learn that I'm pregnant.

Feburary 25th, 2005 AOS Appointment

( went to appt. and requested a reschedule)

June 7th, 05 gave birth to a boy child.

July 5th, 05 Victor packs he suitcase and leaves for good.

July 2005 2nd AOS appointment

( went and requested a reschedule )

August 2005- I file for divorce. and withdraw immigration paperwork.
