What name for Adjustment of Status?

I know this has been asked all over this forum, but I can't seem to find a clear answer on what would be the best way to go...

What name should my soon-to-be wife use on the I-485, I-765, and G-325A?? She plans on taking my name after we are married, but obviously all of her identification (passport, visa, birth certificate, I-94) is in her maiden name. If she takes my name on the marriage certificate, will her EAD and green card be issued in my name or her maiden name like all of her identification? This is just all so confusing and I'm trying to avoid any major hassles if at all possible!

As far as I know it is ok to file AOS using her new married surname as you will be including copies of your marriage certificate, this is what I have understood to be ok from former posts. I have filed AOS this week in my new married name too, so fingers crossed!

As for filing for a SSN, I tried to get one in my married name and it was referred back to the Department of Homeland Security which takes WEEKS to come through. Some people manage to get a SSN in their new name, others do not :wacko: Either way, you can change the name on the SSN at a later stage if you opt for the easier way at this point for SSN and get it in her maiden name. I think if you don't have any document (like the SS card)with your new name, then its is not offical, you have to request the name change in order to use it. Please someone correct me if I am wrong.

04/20/09 - We applied for marriage licence. (Township Municipal Bldg Health Dept.)

04/23/09 - Licence on hand

04/29/09 - Applied for Social Security (He was in system!)

04/30/09 - Wedding day!!! Yeeebaa

05/07/09 - SS card in mail. "valid for work only with DHS authorization"

05/13/09 - Sent AOS paperwork.

06/16/09 - Biometrics Apptmt.

06/25/09 - EAD Card in mail!

06/26/09 - Letter saying case transfered to Cali.

08/08/09 - Residence Card in Mail! Yuuupiiiiiii.

THE END FOR 2 MORE YEARS.

Best to apply under married name. EAD, Green Card, etc. will all be issued in the married name. At some point she will want to have a new passport in her married name, just to facilitate overseas travel. Unless there is some rush, getting the SSN can wait until she has the EAD, so it will be issued in her married name. In most states, once the AOS application has been acknowledged (NOA1), that letter can be used to obtain a driver's license.

Well, I have been working here so I have my ID and SS card with my maiden name. A consulted a lawyer and he told me it's better to use your maiden name and then change it to married name at the interview...which I didn't really understad what he meant :unsure:

I use new married name because at the time we file the package we already got married and my new name shown in certificate of married.

we just received NOA couple days ago. :thumbs:

10-06-2007 met

10-11-2008 engaged

06-30-2009 married

A person should use their legal name. If a woman takes their husband's name at the time of marriage then the legal name is the married name.

Thanks for the responses everbody. After doing some more research, I've discovered that our marriage certificate will reflect the names on the identification presented when applying for the marriage license. The marriage bureau in Las Vegas where we are getting married does not enter the new last name of the bride or make name changes. So, it seems to me that we are going to have to adjust her status using her maiden name because she doesn't have any legal identification to use her married name. Am I wrong in thinking this? Can we still apply for AOS using her married name to avoid having to eventually get a new EAD, Green Card, etc. even though there is no evidence of a name change?? Or does the simple fact that we are married and have a marriage certificate allow us to apply for AOS with a new name??
