Anybody has any idea as to EAD card and AP if the case gets denied?

If it's denied, the EAD and AP immediatelty become VOID. If you are outside the country at the time, they may not let you back in. I don't know if they run the AP through the system at POE to see if it's valid, but I would assume that they probably do. So it would come up as void in their system.

My advice: have a lawyer ready and do not travel anywhere by plane. Calling the supervisors may be a good idea. Tell them that you didn't fully explain something during the interview and you want to make sure that it doesn't negatively affect your application.

I am currently in the U.S.. If the case gets denied, I guess that means I need to leave the U.S. immediately? Is there any grace period?

I start teaching in late August. Should I ask my university to file a H-1B for me, just on the safe side? So many things to worry about...sigh

You can't file for H-1 while your status is pending. Just call them up and wait. I don't think you'll have to leave immediately if they do deny it. Even then, you can still appeal it. Good luck!

A small point, I guess, but does your employer know of your one-time communist affiliation? If it is a state university, it would care about that because of possible political repercussions down the road. Is there any action you can take to repudiate your one-time affiliation?

yes, I am going to work for a state university, but they never asked me about my political affiliation during the interview or any paperwork. My major is far from politics and people are more interested in my research than anything else.

Viviansky, The bed is made call the numbers given to you earlier, do not wait for them, start calling tomorrow. Show them the interest in getting this resolved ASAP

Hi Everyone,

We just had our initial interview this morning in Detroit. Everything went fine. The immigration officer asked for a bank statement that shows grocery purchase and other daily stuff (I guess that would be credit card statement) but we didn't have any.

Then she asked me whether I was a member, or have been a member of, or affiliated with communist party. I was a student member of the communist party club while in college for two years but was never an official member. When I filed for the application, I didn't think it was a big deal and to avoid troubles of having to explain, I checked no. I don't know what happened to me today but I said during the interview, yes, I was once affiliated with it. Then the visa officer became very harsh on us, asking us why we did not check yes on the application. I didn't even get a chance to explain I was never an "Official" member of the party not to mention perform any serious role in the party. After that, she told us we would hear a decision from them in the new few weeks.

Do you think we will get rejected? I am deeply worried. Other than this communist question. we have a very strong case. We are both in our late 20s. This is the first marriage for both of us and I have been a F-1 student in the U.S. for over 6 years now. I just graduated with my PhD and just got a job. Is there anything I should do now? What if our case does get rejected, can we appeal? Can I legally stay and work in the U.S. while appealing?

Simply pointing out something Ironic...What if someone from China was a C4C member here, and the Counsulate officer asked if they were a communist, hmmm? The VJ'r would have to hold their tongue, and would probably blow milk out their nose if drinking some.

Try some Irony sometime, or simply lighten up. You will find humor in it.
