I filed a fiancee visa petition in April. Unfortunately, things didn't work out with my fiancee. We broke up! My question is: what procedure should I follow to withdraw my visa. Is it correct that I will have issues if I apply again for another beneficiary?

Thanks

Best to send a letter to the sevice center where the petition is requesting all processing to stop

You will have a "hurdle" to overcome in the future, but it can be overcome

YMMV

Send a letter of explanation/withdraw (brief explanation and include both your/your-fiancé's information) to the service center your petition is being processed along with a copy of the NOA1/I-797C. USCIS should respond with a confirmation letter.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

It'll never cease to amaze me how people are worried about the next petition while the first one is, in fact, still valid.

Could you please verify the fact that I have to wait two years to apply for another fiancee visa?

NO, you don't have to wait 2 years. But if you file another peition within 2 years you will have to file a waiver, it will complicate your case a bit but it is not impossible.

Good luck.

You don't have to wait 2 years, but seriously.... come on... do you honestly think you should be worrying about Visa No. 2 when your Visa No.1 relationship only just ended?

The chances of falling in love with someone from a different country is small enough to begin with and you're expecting it to happen again... within 2 years. I don't know about anyone else but if I squint and look hard enough I can see a big red flag flying in front of me

Well, I'm not saying I will reapply right away. I was just curious if I fall in love with a girl from the same country. It is the country where my parents are originally from.

No judgement :

There will be red flags if you apply again for anyone. Within the next 2 years will be even more red flags due to having to get a waiver. The onus of proof will be on you to prove that any future relationship is bona fide.

What you write on your letter doesn't really matter as long as you make it clear that you are "Withdrawing your I-129f". Be sure to include the case number and keep a copy for yourself handy. In a couple of weeks call the USCIS to verify that they received your withdrawal.

Best of luck to you and sorry it didn't work out!

When my first petition fell thru USCIS required me to send a NOTARIZED letter of cancellation. They send me a I-797 letter of cancellation about 3 months later

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
