I-846 or I-846A..?

Hey guys!

I just wanted to thank everyone who helped out with our last questions and unfortunately we got a couple more questions about this.. they seem to appear when we least expect it :blink:

I don't meet the financial requirement right now due to being in college, so I am using a sponsor in addition. I am currently in his household and he is filing me on his taxes as a student living in his home on last years tax return. I am not sure if he should fill out the I-846 form, the I-846A or perhaps both? Any pointers here would be great!

Also I am wondering if last years tax return will be enough to prove his annual income, or if we need to include more proof of this? Any help would be greatly appreciated here. This is all we have left before finally being able to send out our K1 package :star:

You would fill out the 864.

Your sponsor (since they are in the same household) would fill out the 864A.

It asks for the most recent tax info, but they suggest to add more (3 years) if you feel it shows more "proof" your capable to support the intending immigrant.

I recommend you send in 3 years of tax transcripts (you get from the IRS) - If your sponsor is well above the 125% poverty level - you should have no problem.

(closer you are to that level, the more evidence you would require IMO)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks for the replies, and also wanted to apologize for posting at the wrong place. I think I might be even more confused now though. While it's not hard to get 3 years of tax transcripts (also well over the 125% limit, yes) like first mentioned here, I am now not sure whether to fill out the 864 or I-134? I have already read the guides several times before, but will do so one more time.. perhaps things will become more clear this time :P Thanks again for the replies, it's appreciated!

Ok So I did another extended search after reading the replies here. At first I thought I (the US citizen) could fill out the I-134 while the co/joint sponsor did the I-184A and that both of these forms have to be included with the first K1 package we're sending out.. even though I did read the checklist stated here before and it doesn't say anything about adding additional forms to it.

At this point, after reading these replies and doing a bit more research I assume both me and my co sponsor have to fill out the I-134, which will not be included in the I-129 package but to mail these to my fianceè once the I-129 has been approved..? Am I starting to get somewhere with my assumptions here? ^_^

As always.. all help is appreciated!

Correct, I-134 for the K visa portion. At the AOS (Adjustment of Status) the I-864 is used. The I-864 is the big commitment.

Did your co-sponsor claim you as a dependent on their 08 tax return? And/or is this person a parent or sibling? If so, they would us the I-864A. If not, the co-sponsor would complete an I-864.

yes you are getting there, you and the co-sponsor (if needed) will each prepare a separate I-134 that is provided to the consulate at time of the visa interview...

So, I notice that your time line isn't filled out. Does that mean that you haven't filed yet?

If you haven't filed yet, don't get focused on the 134 or 864 now, as they are not included in the initial petition, but come later. It is good to look ahead, of course, but don't make this more complicated. One step at a time.

Just to clear it up, you and your co sponsor will both fill out 134s to send to your fiancee as she prepares for the visa interview (after you send in your petition and it is approved).

Once your fiancee has entered and you marry, then you apply for adjustment of status, which requires the 864 (and as answered correctly before, your cosponsor uses 864A).

If you are feeling organized, you can prepare similar supporting documents simultaneously for each and file away one set to be ready for the AOS. Some things might need to be updated though, so you can't do TOO much in advance.
