I was wondering if anyone would know a answer for this. i am employed full time but have been off work since last november due to a minor injury and im on workmans comp. my question is what do i do to show proof of income for filing the K1? any help would be appreciated. Also the form asks for a certificate number from birth certificate what number do i use. sorry this is new to me here.

If you are the USC, you are NOT filing the K-1. A K-1 is a visa. You are petitioning for the determination of eligibility of an alien fiance(e) to apply for a K-1 visa in the future.

FWIW, Proof of income not required with the I-129F submission... that comes later at the consulate interview

certificate number = NONE if none is indicated

If you are receiving workers comp or other disability payments, send copies of those check stubs.

Workmans comp IS acceptable income, provided you have the documentation from the state (or insurance company) your claim is approved and check stubs showing you are paid. You ARE still "employed" but not working. "Working" and "employed" are not the same thing. You can list your employer AS your employer and your income as your normal annual income. Your benefit may be slightly less than your normal "gross" income but it not consequential if the benefit exceeds the guidelines.

Attach a copy of your "First report of injury" and the state or insurance company calculation of your benefit. If you do not have these forms, ask for them. They are required to provide them if you ask. Attach copies of your check stubs. No problem.

so your saying i dont need to send proof of income with the K1 papers? and can i use my last w2 from taxes for proof of income or do i need to use the workmans comp also when needed? or both.

financial documents are needed during the interview.. you don't need to send it to USCIS

When the petition is approved, it will be sent to the foreign consulate where your FIANCEE will apply for a K-1 visa. THAT is when she needs to have the financial and employent information. Probably 6 months or more from when you file the petition.

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

Yes, exactly. She will need it for her visa application interview. Send it a few weeks before. If you are back to work then, the workmans comp is a moot point, if not, it can be used as income as it is gauranteed and the laws require you be re-instated at your position or equivilent position

Not trying to bite the newbies, but as people mentioned above, you should not be "sending in" the K-1 anywhere. The K1 is a visa. If you have a K1, then you are not a citizen of the United States and you have it attached to the back of your passport.

If you clarify what stage of the game you are at you will get much better advice.

sorry you misunderstood this but im in the usa im the one doing the petition not her. and im wanting to make sure i do all this right .and as far as what stage im at .well im trying to get all paper work together and filled out to send in.
