AOS FEE WAIVER, PLS HELP ASAP

I really need help in this area of AOS. I would like to know if anyone has ever gotten AOS fee waiver, any idea? I called USCIS and I was told I maybe qualified for AOS fee waiver only if I fall into one or more categories like receiving food stamps and medicaid, me and my husband are receiving food stamp. I got here in the US 7months ago and already got my EAD and SSN and Driver's Licence. I couldnt find a job, my husband lost his job too, our tax return for 2008 was so low coz he its been almost 10months he lost his job and we have been on food stamp since I came. I want to adjust my status so that I would be able to atleast get a federal and state grant and go to school while we wait for job to surface. I need every help to fill out this AOS form. Is there any free immigration lawyer anywhere? I am in California, does anyone have a similar case like mine? What do I do?

If you are talking about the actual AOS I-485 form, unless you are in special circumstances, I think the fee cannot be waived. The following is taken from a memo that includes a list of the forms that may be eligible for fee waiver:

Form I-485, Application To Register Permanent Residence or Adjust Status, in the following circumstances:

o An alien in lawful nonimmigrant “T” status (victims of human trafficking), under section 101(a)(15)(T) of the Act;

o “U” status (victims of violent crime who assist in the prosecution), under section 101(a)(15) (U) of the Act;

o An asylee applying for adjustment of status under section 209(B) of the Act;

o An approved self-petitioning battered or abused spouse or child of a United States citizen or lawful permanent resident under the Violence Against Women Act (VAWA); or

o An alien to whom section 212(a)(4) of the Act, excludability due to likelihood of becoming a public charge, does not apply, including:

- Applications for Special Immigrant-Juveniles; or

- Applications based on the Cuban Adjustment Act, Haitian Refugee Immigration Fairness Act (HRIFA), and the Nicaraguan Adjustment and Central American Relief Act (NACARA).

The biometrics fee can be waived, but given the delay involved in applying for a fee waiver, I'm not sure that would be worth it.

I guess, but do not know, that the AOS form is not there generally precisely because of the affidavit of support requirement - the person supporting should be able to pay the fee. (Although I don't agree with this reasoning - the fee is a lot of money.)

First of all, I'm hoping the above quoted comments were given with all the best intentions at heart. If that is not the case then I must say my peace. Both my husband and I found ourselves in a very similar situation as blessed devine. Having lost my job in October, not being able to find another one since, and posting a very similar question on VJ about fee waivers. We were lucky and had some help withour AOS fees, suprisingly and very generously given to us, in the way of "pay it forward" (if anyone has seen that movie). I am still unfortunately out of permanent work, doing whatever job I can, temp, to pay the bills. My husband, still waiting for his EAD cannot work. I totally understand the situation you are in Blessed Divine. It is not a position of choice, nor a position one ultimately dreams of finding themselves in. It is very scary, stressful, and belittling. Given this, I don't understand for the life of me why someone would choose to type the above comments, in a response to question for guidance. This forum is geared towards helping each other through the various visa processes, and comments such as these are not helpful. To tell someone who is looking for a job, to keep looking is merely stating the obvious. To tell someone that they are already on governement assistance after such a short period of time is like a kick in the face. I assure you, to all those that may be fortunate enough to have the stability of steady paychecks, that any form of government assistance is not a medal of honor, not bragging rights to your friends, and not in anyway a premoter of good self esteem. I should hope that no one commenting or anyone else for that matter, would ever have to face the difficulties that come from being in a situation like this. But if this is not the case, and you do infact happen to fall into it, then I hope that you receive all the kindness, respect, and humility that you have bestowed.

I did know two people who recieved a fee waiver (from a regular AOS), but this was a while back and prior to what looks like new guidelines. You write them a letter and send it in with your application. Provide proof of any assistance that you recieve. Write out and include a budget. If you are behind on bills, provide proof. I applied for fee waiver myself and was denied (we were not poor enough and I had locked in assets back in Canada). I had to take part in all these clinical studies (lucky I am right near Boston, and they didn't care about my status), in order to get enough cash to apply.

If they deny you, then I suggest you ask for help from your senator or rep.

Hi Blessed, I hope you are well. To be honest, my husband and I received a private donation from a stranger. If you've seen the movie Pay it Forward, it went kind of like that. We were not expecting help, and it came as a complete suprise. If we were in the position to help someone else, we would right now, but I'm still looking for a job and we're scraping by every month, just trying to keep a roof over our heads. We were going to try for a fee waiver, but I'm not on any public assistance, so I don't think USCIS would consider me dire enough to waive our fee. All I can say is keep faith that things will work themeselves out. To everything there is a season, a time for every purpose.

Oh, also, my husband and I had booked an infopass appointment in Feb when we were still trying to figure out how to pay for the AOS fee. We went to immigration to ask for outlets of help. They told us we could request a fee waiver, but they also suggested some non profit organizations that might help. I'll have to check with my hubby as I cannot seem to remember them off the top of my head now. Don't worry, I'll let you know today which organizations they recommended.
