Actually her fidt marriage wasn't real He was not free to marry so legally she was not his wife. At least in the eyes of US law.

Whether the marriage was "real" or vaild or however you want to say it...it really a mute point. He is here, he has a green card, there was an incident. She has some tough decisions to make and figure out how she is going to move forward. Really all anyone on VJ can do is lend support to a fellow VJ member in a time of need.

Leedah I hope you have found someone who can help you sort out your legal issues.

Im so, so sorry Leedah that this happened to you.

She said he had divorce issues when they first married. Usually divorces come in 3 parts. You file then after some time it get approved ( signed ) and then sometimes you must wait X days to remarry. Apparently when they first married that prrocess had not happened corectly. If could have been as simple as they miscounted the wait period by a day. I know someone here that had that problem. The cut 6 weeks by the weekend ( thinking weekends weren't court days ) only to be told that is wasn't good enough. It is actually quite common.

Deep inside yourself; you must face reality now. I have been there and doing that. As stressful as your situation is; it's also your reality; eventually you'll have too decide to report this situation to your local congressman so they will have a record concerning immigration " marriage for greencard" fraud.

If your husband isn't wanting/willing to work at his marriage it's because you have done what he needed you to do and he no longer has a need for you.

I hope that you fight back and sock it too him in which ever way you legally can.

Respectfully, I am confused by all of what you wrote above. Your posts don't read very clearly. Leedah said that she is now legally married to her husband. Despite the fact that there were "issues" with technially divorcing her first husband she hadn't signed the papers when she and her 2nd husband were married the first time (say that three times fast), apparently that has all been straightened out and she is now legally married to the man that is now here in the US. So I believe it was erroneous to say that she is not married in the eyes of the US law. By the time she re-married on paper the second time, she was free to marry. Are you saying that for USCIS purposes her marriage is not legit?

It seems to me that the time frames that people discussed the posts above pertained to whether he had a 10-year or 2-year conditional green card upon his arrival into the US. It also seems to me that for USCIS purpsoses the legitimacy of her marriage to the second husband has already been determined as valid, given that he was issued the CR1 visa. Please correct me if I am wrong.

Had the first marriage been legal he would have qualified for the 10 year card. But because of the do over he should have only a 2 year card. You can not marry someone that isn't all the way divorced. Such issues have gotten in the way of many petitions when people file thinking it is OK if the divorce is final before the interview. Yes they were married based on the 2nd marriage. Even though Leedah may have counted from the original marriage in her heart.

And guess what? He see's how hard the U.S. is and now he wants to go back home to his country but evidently the family won't let him. They say he must work and that they didn't waste their time getting here for him to go anywhere. (um,...last time I checked I filed everything)

Often an immigrant's family is expecting the immigrant to turn into a money tree the day they arrive in America.

Sorry to hear about this turn of events. I am glad that you are doing what you need to do to take care of yourself.

One correction to remain clear in a confusing scenario: He has a 2 year greencard (not visa).

And yes, that has been our experience, too, justashooter.

Question,..

I'm being told by other people from his country and also here in the U.S. that I need to notify immigration of the situation.

I'm wondering what good that would do. From what I see, immigration just chalks up these situations to "I told you so letters".

He is here for the 2 years at the minimum (until he needs to adjust from the CR-1) and I'm sure he will find a way to turn everything around to make me out to be the bad person. Thank god his friends and family back home know how he was treating me.

Anyway, my question is,...if I notify immigration, how is that going to help me? I'm a live and learn type of person,...but if my not telling them will harm me legally or financially somehow....well, that I'd want to know about.

Hi Leedah. This pains me to see what you are going through right now and the immigration process just clouds situation even further. A very very very good friend of mine gave me some advice once about my SO which I didn't take because I was factoring in the human frailties with the immigration issue. One, if your husband shows you who he truly is, especially when stressed, believe him. Secondly, Its easier to swim back to shore when the boat is closer to land. If he wants to go back, pack his stuff for him and send him. It'll save you money and heart ache in the future. If his family doesn't want him back, then that is their issue to tackle not yours. No family in Africa ever wants their relative to return and shame them or come back empty handed. Each person has their own interest at heart, and theirs might be that he is supposed to come here and send money to them. Who knows? Leedah you seem kind, loving and strong. Be kind and loving to yourself.
