IMHO…please, please, please you should seek some form of consultation for yourself first. (Not only for the implications here but also because this is a very stressful situation and you need to be able to talk things out with someone not just us, though we are here.) Try not to let your emotions control your actions. Please do everything you can to make sure you are seeing things within your situation clearly.

I am sure we do not have the whole story but from what you have provided us you probably should speak to a Criminal Lawyer in your State (for the criminal aspect) as well as retain an Immigration Attorney as you will be dealing with multiple issues. Your husband will probably go through the criminal system first. The case could be dropped for lack of prosecution if you do not decide to press charges and the State does not pick it up. However, under these circumstances the State probably will take over. (There apparently was enough evidence for him to be arrested and charged with felony assault.) Even still, as a first time offender it could go to court and be dropped to a lesser offense where he could be offered to take a plea and attend some anger management classes. Either way if the State gets a hold of it, for an immigrant green card holder, you probably could be sure they are going to notify ICE and deportation proceeding could follow.

The following link on immigrant deportation was taken from findlaw.com. I think it illustrates pretty clearly the circumstance surrounding these proceedings for an instance where an alien “[w]as convicted of certain criminal offenses” and even offers you a resource for finding an experienced Immigration Attorney.

09/08/2009- Divorce Hearing

09/10/2009- Divorce Trial (Continued)

03/11/2010- Notice To Appear issued

03/22/2010- Divorced

05/18/2010- Deportation Master Hearing

05/18/2010- Deportation Ordered

06/17/2010- Appeal Time Over. ICE picked him up. In Jail

08/10/2010- Another Master Hearing Scheduled. Out of jail.

05/31/2012- Individual Hearing Scheduled

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

I don't consider Felony Abuse a Joking Matter

I just offered my opinion that there are 3 sides to each story

If I see a weaker person getting hurt, male or female I will take action into my own hands

I don't discrimate if it's male of female I only see Right and Wrong

I will knock someone on their A$$ if they do wrong, Male or Female Don't Matter To Me............

Wow. It's nice to know that you don't discrimate about who's #### you will kick. Really great to know that you believe that hitting women is justified. Has your wife felt your wrath yet? Poor kid, having to deal with you on a daily basis.
