My husband arrived in the USA 3 months ago, and has now left me and his daughter behind to go live with friends in another state. I do not know the address. I called ICE to report him. What other steps do I need to take to ensure that he be caught for fraud?

He has not did AOS yet but has applied, not interview yet.

Divorce comes to mind.

What ever you do - do it in writing (vs over the telephone).

Get a divorce and try to move on. I'm sorry this has happened to you. (F)

There is not much else you can do. His K-3 visa is good for 2 years w/ a multiple entry possibility. He has that amount of time to do AOS, but only based on his marriage to you. If he does not adjust status, he will be out of status at the end of the 2 years. So if there's no fixing your marriage, get a divorce and forget about him....let him deal w/ his situation once his visa expires.

Contact a divorce attorney. He/she will know the stipulations for divorce 'in absentia' for your particular state. You do not need contact w/ him to obtain a divorce....it just may take a bit longer. Depends on the laws of your state.

You can send them a certified letter and explain the situation, but I would start with the div and child support process ASAP. Remember all is not lost, you will survive out of this.

Sadly I am broke and cant afford lawyers or any thing at the moment.

Its sick how someone will go so far and have a child with someone just to get a visa!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Contact USCIS, they will usually require a notarized letter stating your redrawing the 864.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Pull the I-864 affidavit of support. Do it quick as he may get his GC without an interview. If he has the AOS interview without you he's screwed unless he has records you abused him.

Yes, even before the divorce contact USCIS and tell them that you are withdrawing the I-864 Affidavit of Support. If they approve his AOS application with the I-864 still attached you will be financially liable to the US Government if he uses any type of means-tested funding whether you are divorced or not. If you withdraw the I-864 he will not be allowed to adjust status and the AOS will be denied. He will be required to leave the country when the K-3 expires and will not be allowed to adjust status.

Send a written letter to the same address you sent the AOS package, but also send another copy of the letter to your local USCIS office and then call them and ask them if you need to do anything more. If you can manage it, you could also make an Infopass appointment at your local office and hand deliver your request to withdraw the Affidavit of Support in person. That way you know they have it. Don't rely on just one avenue of contacting them because you do want to make sure the I-864 is withdrawn. Canceling the Affidavit of Support makes it impossible to get his green card so do that first.
