No - for the LAST time - as people have told you about 100 times...we have no estimate. If it was a straightfoward case, maybe but your case is difficult and NO ONE HERE can tell how long it will take.

just wait like the rest of us...

Daisy... is there any reason you don't wanna tell us about your location? That could help to give an idea of what kind of case you are facing. Remember people in this forum are not lawyers; just people who have been through similar situations and have the good heart to give support and advice.

And for goodness sake, MOVE!!!!!! Get a lawyer and stop whining, none of us solved ANYTHING by whining, and be prepared to WAIT as many of us had to. I don't mean to be pessimist, but encourage you to be ACTIVE. Good luck!

:blink: My fiancee received on 3rd of July the RFE and sent it back to the USCIS immediately .....My first NOA1 was received on March 10...When do you think I will get the NOA2 ? I know that somebody already told me that nobody knows for sure but I just wanted to have any "approximate" date ??Please I will appreciate your replies..I really would like to have something to look forward to ...( approximate date or month ) ...Thank you....

Daisy, you cannot expect anyone to help you if you don't provide information on what country you are in and which consulate you going through. Each consulate operates differently. No one knows when you will get the NOA2 due to IMBRA. No one can give you even an estimate of the waiting time for an interview, based on their experience, if you don't say where you are.

In the meantime, you need to consult an attorney about your situation and your fiance needs to get started on the 601 waiver hardship letter and evidence. Assuming your interview date is in the near future, you need to be prepared with all of this documentation at the interview so that when you are denied you can immediately submit the 601 waiver. If you don't have it ready, you will just lose more time . . . .

Since you have both an overstay AND an RFE, no one can give you an estimate because NO ONE KNOWS. For all we know, you could be denied at the service center level and never even get a NOA2.

It takes as long as it takes. That is the only answer we can give you because it is, frankly, the only answer there is.

Now I wish I never left the US.What a mistake on my part....
If you hadn't left the US they would have most likely found you and deported you. Without sounding cold they way that you wrote that makes it sound like you just want to get back into the USA. Thats how it sounds, however I'm not saying thats the case, but some people may take it that way.

Like everyone on this forum you will have to wait no matter what...if you love him you will wait, so prepare yourself now.

Everyone here is right, get a lawyer because chances are they will find out pretty fast.

*however my spidey sense is tingling*

  • **Waiting for Notice of I129F approval to show up in the mail!**

  • ** 27th June Email - Saying Application Approved??? **
  • July 7th Packet 3 Arrived (First one went missing? - this one was marked 'duplicate')
  • Pack 4 arrived 31st July
  • Appointment 18th Aug

If you lied on your application and said you've never been to the US or that you've never overstayed, then probably NEVER. If you didn't lie, 10 years.

She just doesn't want to get it or she's pranking us. I wouldn't pay more attention to her. And I do believe she just wants to get back to the US... I'm so sorry it sounds so mean, but that's what I believe.

It took over 90 posts before you finally at least gave your location. I recommend posting in the waiver forum to see if anyone is familiar with the success of waivers in your country. But don't ignore questions the way you have here. If you truly want to be helped, you need to be more forthcoming with information that might help others help you.

What you will NOT get are any absolutes that if you fill out form X and then do Y and Z that you will have a waiver approved in XXX days. There's no guarantee and no absolute answer.

At the very least, you should have your fiance contact an immigration attorney to help with the waiver. You are not helping yourself by putting this off. You have already wasted several days that could have been used preparing a waiver. If you are unwilling to get an attorney, then I feel there is no hope for you.
