Hi everyone! I have a problem, I went to uscis with info pass and asked how to get my wife back in USA. the supervisor said had 2 options. 1 was start a k3 130 all over again and withdraw my I485. Her appointment is april 29th for our interview. The second option the supervisor said was just buy her a ticket and try to come back in to USA at LAX. she said she has seen it before when she worked there at the airport and sometimes they will let them back in . but not a guarantee they will. she said even with expired visa. My wifes father was sick pending surgery and she had to return in an emergency I did not do a 131 when I did the 485. HAs anyone heard of them letting someone back in with there k1 visa expired, This was told to me by a supervisor working for uscis in los angeles, she said it was a risk but they might let her back in,

Passport alone does not get you on the plane.... The airline company will want to know that you have permission to seek entry into the country you are traveling too.... If they allow her on the plane and she is "turned back", the airline must fly the passenger back at THERE expense.... That is why they check for proper documentation... without it she will probably not get on... thai immigration does not set airline policy.... best to check with the airline company....

Passport alone does not get you on the plane.... The airline company will want to know that you have permission to seek entry into the country you are traveling too.... When we bought our tickets thru an agency they didnt question if we had the visas or not. However when we checked in at BKK they did check. I dont think they will issue the boarding pass if there is no visa.

In Thailand at BKK international airport she must go thru immigration check prior to the boarding gates. My wife went thru the Thai exit area & was questioned about her destination as they checked her visa.

If you're lucky it might work. The only way to find out is to try. I know that I was asked to show my greencard by the airline employees in Manchester, England..... before they would even check me in..... after they saw the visa in my passport. And that was with a Canadian passport where there is much more leniency. Like the others say.... it's probably going to be difficult.

besides the obvious logistics of getting on a plane, is that his now WIFE will attempt an entry on a previously used K-1... does not everyone understand the stupidity in all this...

1) K-1 used

2) now a spouse

3) AOS applied for but not AP

4) Status abandoned the moment she left

5) What status will they grant her even if they could... certainly not K-1

I am just going by what was told to me at the uscis office by a supervisor who worked lax, and said she has seen it in the past that they have let people back in with a expired visa, she said they can do a payroll at the airport and let her back, up to the supervisor.. I have never heard this before either. I am only going buy what a uscis immigration officer (supervisor) told me when I went to my appointment to talk to an immigration officer in person at uscis in los angeles, She also said it is no guarantee, up to the officer, my wife called thai airlines they said it is up to immigration, she called thai immigration and they said if her passport was valid she could get on the plane. I do not know for sure. once she is back in she can still do interview. Immigration officer said if she can get back in she can still do her interview. I was curious if anyone has heard of this happening before! if they have heard of someone being let back into usa with expired visa. It is like who do I trust a immigration officer who gives me 2 options do k3 or buy a ticket and see if they let her back in! that was my options giving to me at uscis

It would be worth a try as long as she doesn't get in trouble for illegal entry. If it's only a matter of losing some dough I'd go for it.

Since money is not an issue (as you are willing to buy the ticket on the very low chance she will be allowed to return) I'd say get that K-3 petition submitted NOW as a back up plan.

USCIS does not control the borders... it is the CBP... you are talking to the WRONG agency

Even if they do by some off chance let her in then what? Your current I-485 is void.... You would have a I-94 that is dated AFTER your marriage... how will you adjust?

When this whole thing blows up, come back and let us know how it went

Customs & Border Patrol is the agency that decides whether she can get through the gates at LAX. Perhaps your senior U.S. Senator's office can be of some help -- to alert CBP to the nature of this person's return, and also USCIS to the issue that might come up at the interview. That senator's immigration specialist can do a lot of good contacting just the right persons. You'll never be able to reach those persons who have some authority in this case.

It must be frustrating to all concerned, once your wife decided to return home without following the clear-cut regulations. Has she been overseas for a long time? If so, that can cause USCIS to wonder if you really have a bona fide marriage. Good luck!

Most probably, she wont be able to board the plane and my visa was checked both at home country and London.

If you do this, then it might even taint the K3 visa application ?

I am waiting for my AOS so that I can go back home for sometime and its just wait game .
