My I-751 was denied

Timeline

I filed for my I-751 on 02/15/08 jointly with my husband, we are still happily married. I sent my Mortgage, life insurance, health insurance, my 401k, taxes 2005, 2006, 2 letters from friends and my sister in law, house taxes, bank account statem,ents of the last 2 moths. I did not send pictures because all are in my computer and did not think they will even look at them (like last time in my interview for AOS). I did received a biometrics letter on 03/26/08, i went and everything was ok. Because i did not received the extension letter I called 1800 and then is when they told me i have been transfered to Vermont (I did not received a actual letter), so i asked for a duplicate. I received the duplicate on April 19/08. Since then i did not hear from then, until i got woorry and my extension it was about to expire. I scheduled a INFOPASS appoinment last friday and there they told me my case was denied back in January (i have not received a letter as today) She also called Vermont from there and told me to wait, after an hour later Vermont called back and informed her that my case was in the clerical office (preparing the letter to be send) and that in the letter will explain the reason why i was denied. She did stamped my passport for another 60 days. We are desperated we do not understand why they will denied my case or why i have not received a letter or a explanation. She told me if in 30 days i do not hear from them i will have to come back.

Do anybody has heard about something like this before please advised us. We are worry. It really make me sad the idea of leave my Husband, my house, my family. My husband said he will go with me if i have to leave, but i do not think that is fair, He has a son from his previous marriage that i love like mine, and i know the kid need him too. We will have to start over again from Zero in my country, after working really hard to make this my home. I will really appreciate any advice.

She also told me that it could be something it will be resolved easy and she was really sorry that she could not tell me a reason or give me an advice or what to do.

I am very sorry about your situation and I hope it will be resolved easily and that it is some sort of misunderstanding. I don't have any great advice, but you may want to consider consulting with an immigration lawyer, it sounds like you may need one.

Call your senator or congressman. Don't email them.Call them .One or the other should have a immigration specialist on their staff. My senator just help us with the I-751 BIGTIME!

I don't think u can do anything right now. u have to wait and see what that letter says then u have to start from there.

U can contact ur congressman or representative , maybe they will help .

I feel sick for you. It doesn't seem to make any sense. I mean why didn't they ask for an interview or at the very least send an RFE (although it looks like you sent plenty)? If I was in your shoes, I would contact your state senator's office by going to their wesbite, downloading a 'Privacy Act Waiver/Authorized Release of Information', and faxing the completed form. Usually that gets prompt action. You have to know why you were denied so you can figure out next steps. I'd then follow it up with a phonecall to make sure the fax had arrived.

Here's the thing, I was denied way back at the fiance's petition stage, before I even entered the US. It was all a horrible administrative mistake on the part of the USCIS. (For some inexplicable reason I was assigned a recycled alien number and the original person who had that number was a felon on the run! Some day I swear I'm writing a book about all of this.) Unfortunately the ball was more or less put in my court to run around and get the matter sorted out. I was able to 'fix' their mistake but I'm still a tad bitter about the whole thing. Hopefully your situation will be something stupid and easily rectified.

That is awful! :o Of course you will know more once the letter comes, hopefully it is just a small misunderstanding that can be resolved. :yes: Don't be so fast thinking about returning to your country, you have all the proof needed and you can appeal the decision. AOS approved and now lifting condition was denied!!?? There's some mistake here, is your mortgage, showed your name together and sent the latest insurance (dental, hospital bills) showing you're the beneficiary? Looks like you sent your old taxes instead the latest, need to submit the latest jointly filed tax copy and W2.

well when she sent of her form she probbaly wouldn't have had the latest taxes yet.. the op mailed the package off the beginning of Feb last year...

This is upsetting, I am sorry for you! OP, you don't show your timeline.

Did you file the I-751 on time? You needed to file it within 90 days prior to the expiration of the Green Card. Did you do this?

If this is the extent of your evidence, I don't see much that demonstrates that the couple resided together. Have you moved since you filed for AOS? I am curious why you would not have received an RFE, if the reason for denial is a lack of sufficient evidence.

oh my god, i feel so bad, to hear that. why didn't they invite you for an interview, if they did not like something. that is so strange. i mailed my I-751 form this week, so now i am wondering how many months is it gonna take to get some response from the USCIS.

The proof you had is sufficient. But you should have sent them stuff covering the 2 years and not 2 months. Otherwise it would have been enough.

Something that comes to my mind... if you did not receive the extention letter, there is a high chance you did not receive a possibile RFE.

The OP does not know the reason for the denial yet...so lack of evidence as the reason is only speculation. The bolded items, if they reflect both names, are demonstrative that the couple reside together (the other items can also be proof if they bear both names and the same address)...and I'm not sure what more could any petitioner offer to demonstrate co-habitation. :unsure:

Until you receive the letter - you will not know why they denied you (if they did). So post after the receipt of the letter - what it says and someone can try to help you. (All I can think of was if you were late or the biometrics showed something?) Good Luck

Until you find out for sure, try and gather as much additional evidence you can in case it is needed. Were those joint accounts? Check on this site and see what others have sent. It may give you some additional information for things to gather. Good luck.
