We had our Interview yesterday and things did not go as planned.

We were not approved because the officer asked us to write and sign a RECORD OF SWORN STATEMENT IN AFFIDAVIT FORM.

He clearly said to get Legal Representation so we're also looking for recommendations for a good (low-cost if possible) immigration attorney in the SFO Bay Area.

Needless to say, we're very disappointed with the outcome and we hope it's just a small bump on the road to the GC.

PS: the statement is regarding Angela's entry denial 2 years ago due to visa overstay (by 60 days!)

Anyone here has been is the same situation?

Our Timeline below - CA Service Center - Consulate: Rio de Janeiro - Local Office: San Jose, CA

October 5, 2006: We meet for the first time!

March 8, 2008: I-129F K1-Fiancee Visa Application mailed

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

we got ANOTHER frickin RFE for alfredo's I-485....AGAIN!!! why couldnt they have requested ALL of what they wanted at the same time, instead of wasting our time and their own!!! How ridiculous!!! First they wanted alfredo's 797 from his fiance visa approval, (p.s, i sent it, they just lost it or it got seperated...thus making it MY problem again!), now what the heck could they possibly want!!!???

I am sooo sorry to hear that. I hope things get better and you can find a good immigration lawyer. I still don't understand why they dennied your visa...it was because of your wife's overstay?? I thought the visa dennial didn't have to do anything with the adjustment of status. Besides, they check that when you got your k1 visa, right?

Congrats to those who got their GCs and approvals! It's so nice to hear that someone from March filers are getting good news. On the other hand, I'm so sorry to hear that some of us [including me] are getting some bad news or not getting any news at all. But we will all get through this. Let's just be strong and be PATIENT B) *sigh*

Anyway, does anyone have some input about this? It has been 9 days since my RFE was delivered at the USCIS but got still no updates online. My son's was delivered a day after mine and the online status now is case resumed. Could there be any problems with mine? :blink::help:

When I sent my RFE i never go a response from them and even though I had sent the website didnt change. I even got my interview date for July 30th and the website still says the same thing.
