Ok so recently me and my girlfriend from Romania got engaged. We have read some of the descriptions and requirements but still have some important and more specific questions and this seems like a good place to ask them. So here goes;

1. Is it possible for my fiancee to get an invite from me to come where I am (California, USA) on a visitor's visa and then marry me right when she gets here?

2. Would coming here on a visitor's visa and then marrying be quicker than coming here on a fiancee visa? Like wouldn't it be quicker to apply and get confirmation for a visitor's visa and just marrying when she gets here? How long would this take?

3. How long would it take to process a k-1 fiancee visa? If we applied this month or next month when will it clear for her to arrive? The target we are thinking of by is June-July of this year (2009). Would that be possible? Would it be possible by then even if this is applied later on?

4. The requirements state we must have had met before.....which of course is fine as we have. Will they try to look for direct evidence though? My fiancee was talking about how they might look at whether I had a flight directly to Bucharest or somewhere else in Romania......but the thing is....I came there through other countries. I took a plane to Germany and from there I went by bus and then car around that area of Europe, finally reaching Romania to meet her so there is no direct evidence. Will they be pressuring us to provide some further evidence or will they just take our word for it? Do we have to have some kind of picture together because we did not take one together yet?

5. Once she is here how difficult will it be for her to get a job? She has a college degree from a university in Bucharest but she says it may not help her get a job. What type of visa will she need for one.....will she be able to with a k-1 visa? Or if she comes here by visitor's visa and then marries can she get a job either before or after we are married?

6. What type of paperwork do we have to fill out for either of these methods? What will she specifically have to fill out and what specifically will I have to fill out?

1) No invitation needed... She needs to apply ON HER OWN to get a visitor visa

2) Like yes it would be quicker... by several months

3) Like the fiance(e) visa process could take near a year

4) You put the evidence together to support your meeting... use what you have... pictures help back up the "story"

5) Depends on her skills... K-1 visa or any visa does not help get a job... the get it in there own... can work only when you have received specific work authorization from the USCIS

6) read the guides... you have much to learn

Question 2.

It is legal to go to the USA on a visitors visa with the intent to marry.

There is no such law. IT IS NOT AGAINST ANY LAW YOU ENTER THE USA WITH THE INTENT TO GET MARRIED. What is illegal is to enter the USA with the intent to remain and file for AOS.

There are 1000's of couples who come to the US to get married each year, there is a masive wedding industry based around getting foreign people to come here and have their wedding while they visit.

4. You need evidence of being together in the same country, not of how you got there. The evidence CAN BE as easy as boarding passes but your passport stamps in and out of her country and receipts in country are primary evidence of meeting.

Study the guides. Once you've determined you plan and course of action, download the appropriate forms with their instructions, then read them carefully, interpret literally and answer accurately and truthfully.

Thanks for the replies.....I'll definitely take closer look at the guides. A few more concerns I have though;

Oh that's good to hear. Does that increase the chances of her getting a visitor's visa if she comes here on an intent to marry?

1. I wouldn't count on her actually obtaining the visitor visa.

How come? Why wouldn't she get one? Is it because of the intent to marry? If so would it be easier for her to come here on a visitor's visa without listing any intent to marry?

2. Getting married would be much quicker but she can't stay and adjust status. She'd need to leave before her granted stay expires and complete the appropriate spouse visa process.

Oh so she can't just get married right when she comes and change the status? If we got married right when she came would she have to go back to adjust the status?

I am curious though.....if she were to apply right now for the visitor's visa now or next month would she be able to get confirmation for her to come here by June-July, which is our plan and what I need her here by? I most certainly will.....especially since those main .gov sites don't offer as much info. However I was browsing through the contents of the FAQ and Guides and didn't see specific info on coming here on a visitor's visa and then getting married......can you direct me to that Guide/FAQ? Thanks.

There is no fast, legal way for her to come to the US permanently. IF she gets a visitor's visa, you may marry, but she still must leave the US when her visa's period of stay is up. If you go this route, you may file for a spousal visa after you marry. It will probably take at least eight months, maybe longer. Entering on a visitor's visa with the intent to adjust status is visa fraud. If she tells them she's going to get married when she applies for a visitor's visa, she will most likely be denied, because the consular officers will assume she will visit with the intent to immigrate.

You can file for a fiancee visa now, but that will also take a long time, at least six months, probably longer (usually shorter than a spousal visa though). If she can't get a visitor's visa, she can't visit you while the petition is being processed.

The purpose of a visitors visa is to visit (imagine that!). If she were to tell them that her intention with the visitors visa was to get married and stay, um yeah, no :no:

Seriously, you're going to have to wait. Read the guides at the top of the page. Apply for the appropriate visa (a k-1 if you want to get married here, a k-3 or CR/IR-1 if you get married in Romania, or if you get married her on a visitors visa and then she goes back to Romania). Then wait. Almost everyone here on this site took that route, and we've survived intact for the most part.

If you do things the proper, legal way, she'll be able to obtain a green card, and will then have rights to work. Whether or not she'll be able to get a job is a whole 'nother ball of wax.

Marry yes, stay afterwards, no.

Because she's single and from a country where immigrant intent is assumed.

Quicker to marry but not quicker to be together permanently. Immigration requires the appropriate visa. See the guides. She may marry while visiting but may not stay and immigrate.

You didn't see information on how to commit visa fraud, well because it's visa fraud and because it's against the terms of service here to advocate it.
