We were on our way to a blissful life. The ex of my fiancée was content to let their son come to the US with her. Now we are down to the last couple of months (so unbelievable we are even so close) and he has changed his mind. Now my fiancée is left with a choice to leave her son, or stay with her son. I already know that answer - motherhood trumps fiance. She has 100% custody and he has rights to visitation. I know in the US, you cannot even take the children across state lines without the Ex's approval. We are in shock. We are really not sure what to do next. I welcome your advice.

He really got ya'll good didn't he? :( The only thing I can think of to suggest is to keep working on him - keep encouraging him to go with what he initially said...but I also know how it is to deal with a stubborn ex, so I don't know if he will budge or not. If he doesn't, you will just have to move there until the child turns 18 (or whatever the age is in her country for a child to make a decision such as that). It might be a matter of taking him to court since she already has 100% custody, but the visitation rights throws a wrench in things too. Sorry to hear about your situation and hope things will work out for the best!

08.01.12 - GC arrived in mail

Citizenship Process

12.16.16 - sent N400 packet

12.23.16 - NOA issued

01.27.17 - Biometrics done

02.01.17 - put in line for interview

03.15.17 - scheduled for an interview on 04.21.17, had to write a letter asking for a reschedule because we will be out of the country

03.31.17 - scheduled for an interview again

05.09.17 - Interview!

Sorry to hear of your predicament. You've probably already considered this, but perhaps you could think about moving to her country. There may not be many other options if the father digs his heels in (not that I can blame him either). I'd also suggest that she see a lawyer asap to see if she has any legal options.

Moving there is a possibility but financial obligations prevent me from doing so for several years. I don't blame the father for changing his mind. As a dad I would not want my kids to leave the country. I'll look into the lawyer and "money talks" to see if these are viable options. Thank you for the replies so far.

Yeah, so have I but there is no such law. It's just possible to obtain a court order to that effect.

I would suggest she take it to the courts. I think deep down he KNEW all along he was going to do this just to be a booger..sorry just my thoughts. I would suggest she take all emails letters saved phone convos where he has stated he will allow her to let him move with her to the states.

IF NOT you move there with her instead..that would be the other option:)

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Thank you all for the encouragement and advice. We were considering the "let's meet and do this peacefully" route when she received word today that his lawyer is filing a document with the court that she is purchasing a green card (for $30,000) and that the US Police are investigating the matter. :blink:

When she told me I was caught half-way between bewildered shock and laughing out loud.

I feel like I just entered the Twilight Zone.

Keep mother, father and child in same city/country, until child is 18.

Not sure why you or your fiancee thought it was okay to separate a child from his father. Children, especially boys, need their fathers. Glad to see the father feels the same way.
