Hi there,

I have a quick scenario that I would like to get some pointers on: My wife is an Italian citizen living in Brazil, and we are planning on getting married in Brazil, fly to the US and then get married here. What would be the best way to get her status changed? Can we apply for a K3 Visa or just file the paperwork for a Green Card?

If we apply for a K3 does she have to go back to Brazil/Italy and get her interview there? Is it better to get a lawyer in this case?

I would appreciate some help on this, because we want to follow the best and fastest procedure to be together.

So you are going to get married in two places??? Are you married already as you say "my wife" already or I misunderstood something?

Can we apply for a K3 Visa or just file the paperwork for a Green Card?

Once you are married a USC has to file I-130 petition and I-129F petition as well. It I-129 F is approved earlier she will apply for K-3 visa.

She has to apply for the visa where she lives, she will have interview in her hometown.

If you think that you won't be able to do filing alone and gathering all the documets (requiered ones) then you can hire an attorney as well.

You can apply, but she will need to wait in her home country.

it is considered fraud to come here with the intent to marry and then adjust status while staying here.

So you can marry, then apply for a CR1 or K3, but she will have to return home

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. 2) Where is she right now? USA? Brazil? Italy?

First, married is married. If you marry in Brazil, you don't "marry" in the USA too. You can have any kind of celebration or ceremony you want, but you "marry" one time for each spouse unless you divorce and marry again.

Start with the guides. (Click on "Guides" at the top of any page here.) In short though, if she already has a visa that allows her to enter the US, she may well be able to come for a visit after your marriage in Brazil but she must not overstay that allowed visit time. I would advise taking the CR1 visa route, not the K3 anymore. It has outlived its usefulness for almost all cases.

Actually, they can marry in the US, after hes married in Brazil and once the K3 is approved and she is over here. I was married in the US, we have a marriage license...and we were married in Romania for Eds family..it wasnt a ceramony, it was a romanian wedding.

My friend from my previous job is from Peru. She was married here in the US first for his family, with marriage license...then went back to Peru and married there for her parents...she was already naturalized by the time they married here in the US, shed lived here for 10 years. However, she has 2 marriage licenses. One for Florida and one in Peru.
