Abandon the I-129F???? Help!

Hey everyone!

We recently received email notice stating that our I-130 was approved (WOO HOO)!!!

Then checked online, and our I-129F was approved too! (same day)

I'd prefer to do the CR1 route seeing as it's a conditional 2-yr green card immediately, rather than filing for EAD and waiting anoooother 90 plus days.

When should we abandon the I-129F? And HOW do we abandon it?

I don't want to do it too soon, but whatever one goes faster is what I'm looking to do.

Anyone else do the same thing? Recommendations?

u don't have to abandon K3. u can go with both of them same time. for CR1 u deal with NVC and K3 with consulate in the beneficiary's country. if K3 goes faster, and the interview date for interview will be before interview date for CR1, u can change the k3 interview for CR1 interview. so best way is to go with both, and try to make K3 work for CR1 time wise.

I 130 and I 129F NOA2: 12 dec 2008

NVC process:

NVC received and assigned case number for both: 18 dec 2008

(break in the process- Lee comes to spend holidays here 22 dec-5th jan 2009)

DS 3032 generated :? ?

DS 3032 sent : 26 dec 2008 (friend sends it, based on how fast Ds-3032 was generated for Sracastillo and others who had same NOA2 date as me-risky, but worked)

received AOS package and IIN number in mail : 29 dec 2008 (same friend picks up mail and sends us the IIN)

pay the AOS bill online: 29 dec 2008

AOS shows as PAID: 30 dec 2008

my husband goes back and bags with our papers get lost : 5th jan 2009

package IV fee bill generated and paid online: 7th jan 2009

recieved bags and papers: 9th jan 2009

sent AOS package: 9th jan 2009

package IV bill shows PAID and sending package IV : 12 jan 2009

case complete: jan 20th

interview march 30th 2009

I129F

NVC mails I129F package to bucharest embasy

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless

I also would like to know what to do in this case - if I-129F and I-130 gets approved around the same time. If thats the case, how to opt out from I-129F totally and to just go with I-130? I am guessing this is the best route to take, Please advice.

2008-08-27 : NOA1 Approved -I-129F

2009-02-12 : RFE Email

2009-02-17 : RFE mail Rcvd

2009-02-20 : Traveled 2 India to correct the RFE issue

2009-03-02 : Mailed the corrected RFE Docs to USCIS

2009-03-04 : Received confirmation via email from USCIS that they received the RFE documents. CASE RESUMED

2009-04-02 : NOA2 Approved for I-129F and I-130 via email

2009-04-08 : NOA2 Arrives in mail for I-129F and I-130

2009-04-11 : Received letter from NVC stating I-129F case has been forwarded to EMBASSY for processing.

2009-04-15 : Case Number Assigned - Received this by speaking to a live operator. NVC automated message was not updated-it said "NO CASE# Assigned"

2009-04-17 : DS-3032 sent (by e-mail)

2009-04-20 : DS-3032 and AOS bill generated

2009-04-20 : DS-3032 sent (by e-mail) again after receiving the email for DS-3032 and AOS bill generated

2009-04-20 : AOS PAID (online)

2009-04-23 : AOS package sent to NVC

2009-04-24 : DS-3032 Choice of Agent accepted - Beneficiary received email - ACCEPTED one was 4/17/2009 email

2009-04-24 : IV Fee bill generated

2009-04-24 : IV bill PAID - showed PAID ON- 04/25/2009 and printed coversheet

2009-04-25 : DS-230 sent to NVC

2009-05-07 : case complete at NVC

Embassy Journey

2009-05-13 : Forward the case to Embassy in Chennai, India

2009-06-18 : Medical

2009-06-26 : Visa Interview

2009-06-26 : Visa Approved

2009-06-29 : Visa in Hand

For other readers, if you want an immigrant visa, don't file an I-129F for spouse.

You may simply not respond when the consulate contacts you about the K3 visa and wait for the CR1, or you can pursue both and hope the I-130 arrives so the K3 interview becomes a CR1 interview. Consulates are not allowed to issue K3 visas when they have an I-130 on station for the same beneficiary.

Facts are cheap...knowing how to use them is precious...

Or....it applies even when the "Consular Immigrant Visa Unit" is housed in an Embassy. Visas are a Consular service, not an Embassy service.

I can only relate what happened in my case. I filed both K-3 and I-130 which is the CR-1 in 2006. The K-3 was denied 3 times, revoked and sent back to America. One day after the 3rd denial in February 2008, the CR-1 appointment letter later showed up in the mail, and that is how after 2 years my husband finally got here. I flew to his country for the interview loaded with a ton of evidence and 3 weeks later (May 26, 2008) he was in the US. He got his green card about 2 to 3 weeks later after arrival.
