Even though I am working through Marc Ellis I am looking for references to lawsuits against DOS for mishandled petitions. After entering visa hell I like to know what other have successfully gotten from the government for their mishandling of the process. It really irritates me at times that the only thing Joseph and I really have a timeline for in the future is taking his fathers throne. It is so irritating when corruption at the embassy/consulate level like exists in Lagos keeps couples apart.

Yes are you implying they have an unlimited amout of money to pay damages. They have made false a conflicting statements since the interview. I think they count on you being afraid of fighting the government.

My congressman ( David Drieir) is useless. One of the false statements was directly to his office ( that my spouse (?) did not qualify for this class of visa ) the originally document from the interview claimed lack of a relationship because my fiance didn't know details of a DOD classified job.

And I never thought that ANY other consular post could rival the incompetence and pure EVIL of "mine." We should match the respective personnel on a reality or game show that we call "Hose the Visa Applicant." The most incompent and diabolical acts "win." (What's the prize? Faulty Plexiglass shields and throttling by the neck? Such a dream for so many.)

In answer to your question, I don't know about actual lawsuits. Another VJ member (hosed at Guayaquil, as I almost was) lives in Arkansas, and he talked to a fellow who was very close to ex-Pres. Clinton. This fellow said that Clinton himself considered the consulates "untouchable," even by the President. Sadly, we can all guess that the people higher up in the DOS almost certainly rose through the consular ranks themselves.

At your stage of brick-wall frustration, I sincerely and strongly recommend that you register for e-mail or phone consultation with an outstanding immigration-law firm -- Tindall & Foster, the largest such firm in Houston. Go to http://www.tindallfoster.com and follow the directions. The e-mail & phone consultation rates are exceptionally reasonable, surprisingly so for such a distinguished firm. The office coordinator will contact you; have your story typed up and ready to paste into an e-mail reply to him. Request assignment to (attorney) J.J. Slater with help from (attorney & ex-Vice-Consul) Mark Cross, and say that you were referred by a previous customer. I can absolutely state that I got FAR more than my money's worth in time, wisdom, and CONSIDERATE COURTESY from this wonderful outfit. I know that they are helping other VJ members, whom I referred. Given your level of frustration, I recommend them to you wholeheartedly.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

REMEMBER, THEY HAVE UNLIMITED SUPPLY OF MONEY AND LAWYERS.....

Heck, they can just print more money if they run low :P

Basically, the US govt is immune from lawsuits, as is any soverign nation. There are very narrow circumstances where you can sue if approved by the attorney general, like an accident with a US mail truck where you suffered personal injury.

They are not going to pay just because they mishandled petitions,l or dont give you a straight answer.

Your remedy is a writ of Mandamus....to order a govt agency to do their job.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Thanks for the suggestions. It is so stabbed in the back annoying when things like this happen. I have been working on gowernment "stuff" for 30 years and to have them say I filed for a relationship that wasn't bona fide really got me mad. We plan on marrying there in about 18 months if we don't get things straightnted out and in about 30 months he takes his fathers throne and I will be lolo ( queen ) I have actually been asked to do some speaking to groups this and to considering writing a book . That will at least give me one avenue to vent about how corrupt the Nigerian mission is.

I have been working on gowernment "stuff" for 30 years and to have them say I filed for a relationship that wasn't bona fide really got me mad. Scams and corruption are pretty much the normal in that part of the world.

You will not find a competent lawyer to do this for you unless you pay a large upfront retainer and hourly fees. Unless you are very well off and have a very very strong case it is likly you are wasting time and money.

You will not find a lawyer to do this on a contingency fee basis and attempting to do it yourself is simply a waste of time. The law is very complex in this instance and the only way it could be done with any chance of success to to pay a lot of money to an attorney skilled in this area of the law.

I would wait until he is King and then he can qualify you for diplomatic status and then you and the King can come and go as y'all please. In fact as King and Queen I believe that would enable you to call on the embassy at will and state your concerns in person. Also as King and Queen isn't there a hotline or something?
