Hello, I'm surprised that we haven't received an RFE from USCIS regarding I-864. Our interview date was scheduled on Feb 11, 2009. My wife's income for 2006, 2007 were below the poverty line. But when we filled out form I-864 we put my wife's estimated current income for 2008. We took the risk for not having a co-sponsor. I was wondering, if we can file my wife's income tax return for 2008 before our interview date and bring the copy to our interview. I'm just afraid that this will become an issue during our interview date since my wife's income from previous years were below the poverty line. I'm hoping that my wife's W-2 will come early before our interview date so that we have something to give to the interviewer in case it will be asked. What are the negative outcomes if we can't provide a copy our 2008 income tax return during our interview? What would be the best thing to do? We don't have a joint sponsor.....our strong weapon to this battle is PRAYER!

Does she have a recent paystub? That would show her income (its pretty simple math to figure out what she makes per year based on the paystub.) and if that is above the necessary income level you will be fine. Her employer should have a record of her pay. I'm sure they would be willing to give her something to reflect her income even if it is just a letter stating her current position and salary.

Tell your wife to ask her employer for her W2s as soon asap.

Best to file the 2008 ASAP. Take a copy , w2, employment letter and you should be OK.

you should relaxx my man... this is not a battle... is just a process... the outcomes of it.. is that sooner or later you get approved... i know that your gonna have a smooth interview.. .. as long as you married in good faith.. that should be your confidence..

This comment is uncalled for and offensive. Posters are free to state their basic faith, as they often do. Christians, including Catholics, believe strongly in the efficacy of prayer as a way to maintain their serenity in the face of uncertainty.

The law requires the W2 be mailed by January 31. I would think the W2 or a tax return will satisfy the adjudicator. I'd file the return if possible.

Facts are cheap...knowing how to use them is precious...

hmmm.... I am not a tax specialist but I do believe you can file your taxes without the W2s if you have your last pay stub and report all income to whomever you have to prepair your taxes.

she wont have to have her W2 to file. secondly as was stated before by law her employeer is required to provide her a w2 by thhe 31st.

Someone else stated that an employeer will write you a letter. I hope she has a good HR or payroll department some bigger companys wont write a letter and others require (like mine) a noterized letter stating its ok to release the information.
