So sorry to hear this! Was the RFE looking for something specific? It sounds like you had a lot of evidence so I'm puzzled what they could be looking for....

And Texas is one of them. Last time I had to update my DL online it did not let me. So, when I went to the DMV office I have been told since I am not a US Citizen, they will need to see my GC. The good thing though is they do not put the expiration date to match your GC yet. My DL is valid till 2012.

When i first applied on 2005 all they asked for was my MA driving license, and another ID which happens to be my Marriage Certificate.

Hi DrewNSue,

I'm sorry that this situation has to happen to you and your family. And yes, it sure would be frustrating that your wife's I-751 is still processing, they gave her an RFE at the last minute despite submitting sufficient evidence, and that your wife's driver's license will expire soon.

Nevertheless, it's a good first step you took by sending in the evidence they wanted and by making an infopass appointment with an immigration officer to address this issue in-person as soon as possible. I hope you are able to make an infopass another appointment at a sooner date that is more convenient travel-wise and time-wise. And I hope that regardless of when you have your appointment, that all goes well you and your wife there, for a speedy and quick approval.

As for the situation about your wife not being able to drive while her case is pending: Just in case, have a list of phone numbers (911, emergency depts, family, friends, neighbours, etc.) handy for emergencies and for any individuals that can offer rides in any situation regardless. Also, have extra money/change for alternative travel means (bus, taxi/cab, train, etc.). I agree there, that your wife and your child shouldn't have to be "stuck at home" (especially in an emergency situation and when a small child's life might be at stake) just because of the USCIS's incompetence!

Ant (Still waiting at the VSC, Still waiting for Baby...)

It's been awhile since I posted on the site, I had figured everything was going so smoothly. I should have known....

-January 8, 2008 submitted I-751 w/ tons of evidence (mortgage contracts, affadavits, mail, bank statements, insurance policies, child's birth certificate, etc)

-Recieved the NOA stating my wife's GC had been extended one year from date of reciept. (Jan 10, 2009)

-Called several times throughout the year to check on the case, and was told repeatedly it would be processed towards the end of the year or the start of the new year. (Vermont Service Center).

- Got back from visiting family for the holidays, on Monday Dec. 29, and there is a letter from USCIS waiting for us. "Great!" I think, and open it up. It is an RFE.

-Call USCIS, fuming, and explain the situation. Woman tells me she's sorry, and that the best I can do is submit the evidence as soon as possible, and schedule an INFOPASS appoitment to see about getting an extension or her GC somehow.

-Sent all the paperwork (everything in the original, with EVEN MORE inane stuff) in overnight, certified, via FedEx. They won't get it until Friday due to the holiday. Schedule the INFOPASS appointment for the earliest date available, January 22 (GC will be expired). And it is in Norfolk, an hour and forty-five minutes away, even though there is another office thirty minutes away. Grrrrrr.

So now, unless they process and approve her case in a few working days, my wife's green card will be expired. That also means her drivers license will be expired. We have a twenty month old daughter, and I work about thirty minutes away. I am so worried she will need to get somewhere and be unable to. This doesn't even mention the fact that her status is completely up-in-the-air. If she needs to prove her citizenship or show ID for any reason, we're in trouble.

I am at my whit's end. I am pretty sure that unless the case gets approved (and hasn't been suspended or held up in any way), we have to wait until the INFOPASS appointment. That leaves us dangling for two weeks without any proof of permanent residence. Is there anything else I can do? Has anyone had a similar thing happen to them at the I-751 stage? Thanks.

I'd suggest trying to get the appt with the USCIS office closer to you - you said you had one half an hour away - just change the zip code so the system will accept it. They don't ask you what zip code you're from.

Something similar happened to us. We never got the NOA1 extension letter. We made an info pass appointment, and had my husbands passport stamped. They told us the only way we could get the stamp would be to provide them with the expired residency card. I just laughed, and said, oh you want the card that is expired and ummm worthless for our stamp, NO PROBLEM. Good luck!

I'd go to the office closest to you and do a walkin! Only thing they can do is say no!

That's the way we used to do it before infopass.

I just wanted to mention that NOA1 extends conditional status for 1 year from the date on conditional green card, not from the date on the receipt.

The GC might be but not the DL. Wife went to the Fairfax, VA DMV and they extended her DL one year from the date of the letter (even arguing that that's not the valid expiration date did not work). Anyway time to get the passport stamped.

Regarding the stamp in passport, can anyone suggest which option to pick in InfoPass? I might be going too far but don't like to be sent back saying that not the right option was selected when making appointment.
