10-15-08 - new RFE finally in the mail (after hundreds of calls to uscis)

Are you required? Do you HAVE to? NO..

As is indicated in the in the instructions, you have the option if you believe it will be beneficial to your case

You will need to send proof of having met in person atleast once in the past 2 years, (airline tickets, boarding passes, a few pictures of the 2 of you together), copy of the receipt of the engagement ring (if you have one).

The proof of ongoing relationship will be required at the time of interview so start collecting on it now (phone bills showing calls, chat logs, receipts of gifts and money sent to each other, cards, letters, pictures, plane tickets/boarding passes from more trips etc)

You'll be involved with an exceptionally high-fraud embassy, so my strong advice is to include copious amounts of "proof of relationship" information in your I-129F filing to USCIS. (USCIS will not care.) The benefit of including this material now is that, when your petition is approved and the package is forwarded to the embassy, the "proof" material will be there, and the embassy will not be able to deny (with legitimacy) that "there is no proof of the relationship."

Also, because (probably) comparatively few other filers are doing the same, your application may stand out in a positive way once it reaches the embassy.

By the time of the visa interview, you will have additional proof to supply.

I wish to high heaven that someone had recommended the above to me during my own I-129F filing, because it probably would have saved months of heartache and of being jacked around. Read my signature.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would include a few proofs of ongoing relationship. 2 years of chat logs is waaaay too much for your I-129F. Maybe include a 1 for every month you've been together? I would however, print them all out for the k1 interview.

Make sure you make 3 copies of everything. send 1 to USCIS, keep one for yourself and send one to your SO. After you submitt the K1, continue to collect evidence and make copies for you and your SO.

Chat "logs" that show how frequently you chat along with a few pages of examples of the text of your chats spread over time would be good. If you have other evidence and some pictures, include that. The most effective evidence of bona fides is your time together in person. Be sure to document that as your highest priority.

Generally, I only suggest this when there are obvious red flags in the case. That the application will end up in Lagos is red flag enough.

Facts are cheap...knowing how to use them is precious...

Of course I would not send 500 pages of paper, a" few of this and a few of that would do the trick"!!!!! I can remember that my application file did include a lot of extras.....boarding passes for bus trip, a picture of flyer attending church ceremony as some of the pics submitted included pics of pastor and wife, hotel bill receipt, the very first introduction email sent and chats leading up to visit and my return from visit, sent copy of invitation letter, copy of cell phone bill with the calls(included his phone number and the length of minutes talked), sent copy of 2cards, a few email exchanges and a copy of him paying to send me documents to my mailing address via EMS speedypost Nigeria.
