Hi,

My fiance finally made it here, he arrived on Friday, we applied for his social security number on Monday. He flew through JFK and received at JFK a 1-94, I want to know what we have to do in order for him to have the correct papers to work. Is there anything additional I need to file??

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Unless he also got a temporary EAD stamp, you'll need to marry then apply for adjustment of status and EAD. See the "GUIDES".

If he got the temporary EAD stamp at JFK, he's authorized to work for 90 days only. Good luck getting somebody to hire him. You might during the holiday season for a temporary job.

The I-94 is not the work permit. It just shows you when you entered the US and under which circumstanc....in his case K1.

The I-94 would also have the work authorization stamp as well if they gave it, with an expiration date of on or about February 19, 2009.

My husband came in July. He got it automatically. They didn't have him say anything actually. They didn't even ask him questions oddly. But it was on the back of the I-94 and it is a red stamp that says he is authorized to work and a date is written in ink on the red line. Hope that description helps you.
