What are the rules about flying outside the US when Fiance gets here on a K1 visa.

So once my fiance comes to the US, will we be able to fly outside the US, or take a cruise for our honeymoon. Will she be able to do this kind of stuff using her K1 visa, or should we wake until she gets a green card. Im not too familiar with the requirements.

She cannot leave the US while on her K1. It's a one time only entry. You need to get AP (file for it when you file AOS) or the greencard to leave. Honeymoon in the US (you can go to it's territories as well, though some people don't recommend it) or wait until you get AP. Leaving the US without it will mean you have to file spousal visa and restart the whole process. DON'T DO IT

There are no restrictions on leaving but if she leaves, she won't be allowed to re-enter. K1 is a single entry visa. Stay in the USA until securing AP or LPR status.

What about cruises to Hawaii and Alaska? Just don't get off the liner in stopovers in non-US territories if there are. Is this still ok?

If the ship leaves U.S. waters then you have left the U.S. I doubt it is a simple as not getting off the ship at the port. To me it seems risky, even if the cruise is supposed to only be in U.S. waters, there is the chance that something could go wrong on the way to Hawaii and you could find yourselves in Int'l waters. I'd rather not run that risk and have my girl get deported over something so small.

I'm assuming it's the same as flying to those states. In any case, you would be going outside the lower 48 and be in international waters or airspace. As long as you don't get out of any of the 50 states, I believe that's ok. Not so sure about us territories though. I'm planning also to get a cruise. Perhaps somebody can furher shed light into this.

Oh no I was thinking of going to Hawaii for out honeymoon, now I will have to put my thinking cap on again, I dont want to take any risks

Unless you're going on a New England cruise or something, cruises seem risky--I've had to go through customs after all cruises I've ever taken. After all this, why risk having it all blow up on a honeymoon? If you really want to go somewhere outside of the U.S., why not just wait until AOS is completed and then go on a delayed honeymoon?

As long as you don't get out of any of the 50 states, I believe that's ok. Not so sure about us territories though.

This is slightly disheartening because we were planning on getting married at my parents' home in the US Virgin Islands. We intended to fly there (which does not require having US Passport), and fly back to our home without ever leaving the US.

If anyone else has information or personal experience, I would be most grateful.

A...Maybe not a wise thing to do. Even though these islands are US territories or possessions, you may have to deal with Immigration and Customs to get back to the United States. You might have trouble getting back home if you encounter an insane USCIS (INS) inspector, plus, there are too many opportunities to "technically" leave US jurisdiction (by visiting the adjacent islands, for example). Best to take the honeymoon somewhere in the 50 States, where there is plenty to see and do.

A..Let me make it as clear as it was explained to me and which the regulation bears out: So long as the K-1'er does not depart ("depart" is also defined in the reg.) the US after making a legal entry s/he can travel to any other location which includes the USVI, PR, Guam, Hawaii, and Alaska.

The inspector I spoke to gave clear examples. (My alien fiancée) can enter the US and we can fly directly from the mainland to the USVI. We can go wherever we want on the islands so long as we don't "touch" ground or water not under US jurisdiction. When we leave she shows her K-1 and I-94 to immigration (which shows she legally entered the US) and off we fly directly to the mainland. However, if while we are there (USVI) we decided to take a trip to the British islands then she would be denied re-entry. I know I used "directly" in this example but we could fly "outbound" mainland-PR-USVI and "inbound" USVI-PR-mainland without fear because in this case she never "departs" the US.

Inspectors (both mainland and USVI) told me that this is not an unusual occurrence. They see K-1'ers all the time.

I mean a cruise would be amazing or a wedding in the virgin islands...HOWEVER if it RISK having your so not getting entry back in I would NOT DO IT!

There are other places to get married in the US along with beautiful places to visit for a honeymoon.

There is no risk in traveling directly to and from the US Virgin Islands. The risk would be attempting to travel outside the territory e.g. taking a cruise, kayaking to Tortolla (British VI), etc.

Prudence is always welcome, but fear has no place in my life.
