i just called the VSC. they told me the following:

they are currently processing I-130's submitted on Feb 26, 2008

they are currently processing I-129's submitted on March 4, 2008

hopefully good news will come soon..

I-130 NOA1 - Feb 27, 2008

I-129F NOA1 - March 10, 2008

I call last week and was told VSC was still processing Feb 1st. This would add up with the 6 month window with their August 31st date on the latest update. If they are processing March 4, 2008, we should see some approvals soon I hope. I just don't understand why they just post their processing dates with the same date as the posting date. I just feel they just want to impress the politicians with numbers instead of helping families get reunited.

I hope I see some approvals coming out of VSC soon.

exactly, updating it yesterday and putting the updated date of august is a scam which would not really make sense to anyone who is in the right state of mind.

Somewhere in the Obdusman report, it was suggested that appropriate timeframes are posted on the website to allow transparency. USCIS rejected the suggestion - that tells the story why we may never see right times on the site. Its all OK as long as people don't have to wait this long for approvals.

I wrote an email to my Tennessee congressman, and he responded back in a letter from Washington, DC, telling me he will investigate our case. Then I checked the USCIS web site and saw for the first time they have that 6 month window instead of a date now from outside the window. Then I checked VisaJourney, looked at my timeline there again, and see they now for the first time moved the estimate BACK instead of forward again...! They moved backwards from November 4 - November 29, backwards to October 29 - November 19.... So all those things together give me considerable hope.

I think there is some serious movement about to occur.

Guys, be careful what you believe coming out of VSC. I spoke with an agent there last Thursday (yes, at Vermont, not the national center), who told me they were working on April 2 for the I-129F K3. And then I called there again today when the processing dates changed on the national site, and the agent this time all but refused to talk to me, and to go back to the national 1-800 number.

If you look at that list that guy Igor has and continually updaes, he shows like 80 to 100 people alone who are members of this website who have I129F NOA 1 dates of March, February, and even January that have not been approved (more delinquencies for K3's than K1's). I think for all of us with March or early April NOA 1, the reality is we could be approved tomorrow, or two months from now. It's impossible to accurately guess, because no one at USCIS is willing to offer a straight story on it.

Also, there is another guy I see posting to these websites that believes the six month period starts from your I-130 NOA1 date, when it comes to processing your K3. That is not correct. It comes from your I-129F NOA 1 date.

I wish everyone luck, but I think there's a good bit of "over-analysis" going on with this. Which is understandable, considering we are all but powerless in this process.

while I agree with you about the over analyzation going on, you cant go by Igor's list in this manner. His list takes into account, people who have never come back here to follow up with their timelines. Several of them have just dissapeared for several months.........

Yeah you're right but I know some of those people he has on list and who are still active, and are pushing 9-plus months. His list has deficiencies, without question, but I think his stuff is a more accurate gauge than any of the drivel USCIS is pushing. I have two weeks left until I can submit my inquiry request (at 7 months), and I have this sick feeling USCIS will change the dates again. I just do not trust anything they say up there anymore.

What number did you call to get to the Vermont Service Center? Our I-129 is 30 days outside the six months processing time. I would love to talk to someone and if there is a chance of getting the ball rolling. Our petition has had no activity since May. Thanks in advance and good luck!

The six months only refers to the I-129 NOA Date. This means that if your I-129 date is before April 20th, you are outside the processing time. Or if your I130 date is before the posted February 26th date.

I called the USCIS hotline using the options listed in a previous post which connects you to Vermont Service Center. I was connected to a lady who identified herself as "Officer Norma". She looked up my information and confirmed that my case was 30 days outside of the processing window (it's actually 25, but she said that was close enough). She also confirmed that I hadn't received an RFE and that there was no activity on the case in the last 60 days. Because of these things, she told me to call back and file an expedite. Didn't make any sense to me... but at this point, if someone told me to do the hokey pokey I would try it.

So I called back to the 1-800 number and pressed some options that indicated I believed I was outside of the normal processing time. I was connected with Agent Jeff who again looked up my information. I told him what "Officer Norma" told me and he rattled off a list of reasons for an expedite. He took my information and filed a service request for the expedite. He told me that I should hear something within 5 days.

From the other end, I spoke with the representative at my Congresswomans office. She tells me that the processing time for the I-129 is Feb 1st. I have to literally beg her to open a web browser and see that the processing date was updated. She then tells me that ... they just updated the date so give them some time! #######!!! Seven months isn't enough time?? She said that they told her that my case was assigned to someone and to call back within a week.

Some of this should make me feel better... but I simply feel deflated at this point. Sorry to vent...

It's been proven over and over, and verified by many people that have contacted USCIS that they process based on the I-130 NOA1 date, NOT the I-129F NOA1 date. See my time line for example. I have seen people that filed their I-130, waited 3 months to file their I-129F, and were approved based on their I-130 NOA1 date.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!

And I know people who have been approved inside of the 3 month date, just by blind luck. USCIS has no obligation to follow up on your K3 status based on your I-130 NOA 1. It is based on your I-129F NOA 1. You are wrong on this opinion. This has been verified by USCIS staff, and my attorney, who was a former US immigration judge. If you do not believe me, call an immigration lawyer and ask them.

Although often times the approvals conicide with thw I-130 NOA 1 date, USCIS does not use that date to determine whether or not you are outside of your normal processing times on a K3, which is what many of the people on this website are facing. You need to get your facts correct before you distribute information that gives people a false sense of optimism.

Fortunately my I130 and 129F were submitted within 2 weeks of each other.

Regarding the change about the 6 month window, to date I have seen NOTHING even vaguely encouraging coming from there, so, this is a change, aty least... a small change, but a change none-the-less, and am going to take joy in ANY change. At least I know they havent all died and there arent cobwebs among their bones there! hehe We need to put pressure on more through our representatives. Everyone here should be getting their representatives involved. I for one, believe that the squeeky wheel gets the grease. The more noise we can make, I believe, the better.

i called VSC on friday and talked to a guy who would refuse to give out any info and asked me to call national customer service for case status. i asked for his name and he identified himself as officer (i dont remember his name)...i asked him again if he was an officer and he replied "yes"...to this i asked, well what is ur nature of job or if u do anything different that the customer service reps. i asked this question coz i wanted to know why he is getting paid if he cannot answer my question (afterall its people like us who pay their salaries). he got really pissed off, said that he is not obligated to answer that question to me and hung up on me. i wanted to say, "darn right, you are obligated to answer my question coz its people like me who help pay his paycheck"...but, he had already hung up the phone.
