:crying::crying: we send them all the paper work they asked for, but still they denied our fiance visa, they mailed all the paper work back on 25th of sep. :crying: i don't noe wht to do now, im mad, sad , god didn't help us ,

I am sorry to hear about this. You can go there (India) to get married and come back to the US and file the paperwork for the CR-1 visa. You can also have your fiance come to the US on a visitor visa and get married. The only problem with this way is that he will have to go back to India and have proof that he intends to return, like a return trip ticket, or they will deny him the visitors visa.

Why did they deny the K-1 visa?

Really sorry to hear that. Did they give you a reason ? Which consulate did you go to ? I just sent my K1 packet to VSC a couple of weeks and asked for Chennai or Delhi as my fiancee is based in Kolkata and they do not issue K1 visas there.

Reading your experience, I am wondering if I should go to India, get married and file for a spouse visa (CR1/IR1/K3).

Again, really really sorry to hear about experience. Hang in there. Just a few more months and gods will be smiling back at you and your fiance.

9/11/2008 – mailed I-129F

9/12/2008 – Received at VSC/NOA 1 sent (mail stamp-9/16)

9/15/2008 – check cashed

9/19/2008 –Received NOA1

12/28/2008 – Received NOA2 Approval email from CRIS

01/06/2009 – Left NVC for Mumbai Consulate

01/07/2009 – Received NVC confirmation letter in the mail

01/08/2009 – Mumbai Consulate received file electronically and sent packet 3 (info from DOS)

01/10/2009 – Mumbai Consulate received file (hard copy) from NVC (DHL tracking)

01/19/2009 – Overnighted packet 3 (still did not receive receive pkt 3 from Mumbai)

01/20/2009 – Packet 3 arrives at Mumbai Consulate

01/23/2009 – called DOS and was informed that packet 4 has been sent and interview date set.

01/24/2009 – Received hard copy of packet 3 (postmark Jan 20). Too late. Already sent packet 3 on Jan 19.

Sorry to hear that. Since his K1 visa was denied, the only option you got is go to India and marry him and petition him through K3.

Your Fiance will get Mumbai Consulate, cases of Calcutta region gets forwarded to Mumbai.

To OP, sorry to hear about your denial, do think the problem lay with you being an adopted immigrant yourself and that gives CO more reasons to scrutinize your case. Do get married in India and apply for either k-3 or CR-1 and do try to be present there with your husband when he will have to go through his interview in the future.

i would say go there get married and come back and file for cr1 visa... its safer that way..

did they give u any reason for the denial?

So sorry to hear this.. As with everyone.. i would also suggest to go to India and get married and come back file with CR-1/K3.. Don't get upset.. Just try to know why they denied... might be helpful in near future so you won't do that same mistake again...

since it will be returned to calif, they will tell u it expires and u are free to refile..which u can do again or marry and file as married which is taking forever these days either way
