Getting married

Hi- when my fiance went through JFK today, the lady told him he must be in the US at least 24 hours before he can get married...is that true? We were thinking of going to the clerk's office tomorrow so that he can go on my health insurance straightaway. Has anyone done this and had any problems?

I would think the answer would differ by state since marriage is governed by state law. Call your city or town hall and ask the clerk. Sounds like a weird rule to me, but sometimes rules are weird.

ask your HR first if they need to see a marriage certificate. if not, you can just add your fiance(e) as domestic partner (if you have such insurance with your employer) or as wife. our HR did not ask for anything... I just told her I want to add dependents. They didn't even ask for SS#'s.

Judging from your timeline, you are in michigan correct? Well i dont know about the getting married the next day thing but i do know it takes a couple of days for them to get your marriage license.. (I got married in Michigan and had to do the marriage license..) But also note that in Michigan, the license is only valid for like 30 days (I can't remember exactly) Good luck! :-)

In most states you have to have a short waiting period between getting your marriage license and getting married... in FL I think it was 3 days.

There is a normally a three day waiting period for a marriage license in Michigan.

"SEC. 3a. (1) A license to marry shall not be delivered within a period of 3 days including the date of application. However, the county clerk of each county, for good and sufficient cause shown, may deliver the license immediately following the application. A marriage license issued shall be void, unless a marriage is solemnized thereunder, within 33 days after the application.

Although you may have to wait to get the marriage licence, 24 hrs wait since getting into the US seems bogus. The best information on procedures regarding marriage can be found from your county clerk web site or by phone.

yep, it's the state laws you have to worry about here...and most require at least a couple of days wait for the liscense.

Oklahoma and Nevada have no waiting period or residency requirement. Get your license in the morning and get married in the afternoon. There may be others ... those are just 2 that I know about.

BTW .... the Oklahoma license is only good for 10 days.

Very true. We got our marriage license 3 days after I entered the US (it was issued in the 15 minutes we spent in the office), and got married 3 days after that.

I Tennessee you can get married the same day you apply for the license as well.

Another thing to think about is that as a K-1 Visa holder, he is eligible for a SSN, but once you get married he has to wait until he get's his EAD card to get one.

My husband and I got married 10 days after his arrival to the states so that we could start the AOS process. He tried to get a SSN the week after we were married, and was denied. The lack of a SSN keeps him from getting a driver's license, getting added to my bank account and it complicated adding him to my health insurance.
