And, something had to happen to make them think she was going to get married. They do not normally just say, you can't get married.

Maybe she was wearing her wedding dress as she crossed the border.

That's the real issue...what gave the officer reason to warn her...she must have either said something or had something suspicious on or with her. These people can be azzes that's for sure, but they don't just pull something like this out of their butt either.

To the OP...what do YOU think the reason this officer warned her about getting married and filing AOS?

I couldnt really say. i know she did have letters from her friends on her that prob said something that didnt need to be said. right now im just happy they let her past customs. but that would be after they searched her. b4 that i really wouldnt know why they would suspect her. i guess the first thing was. he thought she wanted to be down here to long. (she wanted to stay the full 6 months) maybe that?

i guess it was just they way she made it sound. i have no prob with the man doing his job. but they way she told me he went about it seemed alil rash?

If she's anything like me, I make everything sound so much more dramatic then it usually is. Maybe she was just overly upset about it at the time.

I have to agree with those who said she gave some indication. This is really the first time I've heard of anyone flat out saying that to anyone at the border.

You may just luck out. Candada is one of the few countries that can come and visit during the process. Just have her make sure she keeps the proof of ties to Canada and doesn't overstay any visits. You are very lucky to even have that chance here.

the chance is not only for people from Canada....

also some Canadian got refused to the border....

good advice for next visits when she comes.... travel light.

and don't give them any suspicion that she might stay longer.

the good thing we have in Canada is that if u r refused... u r still in Canada (all the us/can borders are in the Canadian airport if you take the plane)

I don`t know if this helps but friend of mine came here on J1 visa and got married to USC. Prior to getting visa she was forced to sign some paper in the consulate that she is not going to get married while in US. Note here that she was really not going to cuz she didn`t know the guy yet. Guess what????? She recently filed to remove conditions from her GC.

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

Godlike.... errr... yep, pretty accurate. She was officially warned not to get married. Common sense would be a good idea now.

No, she was not. She was officially warned not to marry and adjust status. She can marry but not stay and adjust status too. She must leave the US when her granted stay expires, whether married or not.

That is totally different, though. Sounds like your friend had a real spur of the moment decision, which is fine to file AOS. OP is admiting to entering country with intent to marry. That is considered fraud. Now, again, if she was warned by the officer at the boder, I bet you there is smth in the system saying so and there is a chance of it coming up during AOS and causing major hardships for the couple.

Considering she's Canadian and still can visit, in this case going the legal way is a right decision IMHO.

Now that she's here, file the K-1 visa. She can stay with you now for the next 180 days (minus what she's been here already). When she goes back to Canada, she shouldn't have too much longer to wait for her visa. Then she can come back and marry you and stay!

Yes! Why is Pushbrk the ONLY person to suggest this? It is such a huge misconception that you cannot come here on any kind of visa and get married. It's a free country - go forth and get married if that's what you want to do!! The crux comes AFTER you get married - you still have to apply for the proper visa if you entered with the intent to marry! K3 or CR1.

It is NOT illegal to come here and get married. Why do you think Vegas is such a destination??? It's illegal to enter with the intent to marry and ADJUST STATUS.

Nov 30 2007 - I enter US as a tourist to spend the ski season with my sweetie and figure out what we both want outta life - we plan on ending up in Canada, but...

Jan 30 2008 - We get married in Vegas! We decide to stay in the US.

Feb 08 2008 - File I-130, I-485, AP and EAD

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

Feb 19 2008 - Touch I-130, AP, EAD

as many have said already...go the K1 route and wait it out if you can...true love can stand the test of time ;)

It will all be worth it trust us! ;) there will be less head ache and heart ache down the road.

P.S. My fiance USC came to visit me after we had filed the K1 and I had also gone down to visit a few times as well. I was honest and told them we filed for the K1 Visa and they did not ask for my ties to Canada (although I always carried all the paperwork with me just in case).
