Hi everyone, please excuse me if this question has been asked several times already...June 11 I received emails that our I-129f and I-130 have been approved!!! Now the big question: can we have both processed simultaneously and take whichever comes first?? My understanding of the K-3 process is: the case gets sent to NVC, then to Cairo, then they request some paperwork, which I send to them and my husband; he has an interview. Whereas the CR-1 process: case sent to NVC, they request paperwork, and we send paperwork to NVC, the case gets sent to Cairo, and he has an interview. Is it true that when he gets an interview for K-3, he could go and request to have it processed as a CR-1?? And if so, would this take extra time? I was told this by a uscis rep. several months ago after I first filed. We both realize that the CR-1 route is less expensive, and would allow him to get a green card and SSN sooner, but our priority is to take the quickest route to be together.

They will send it to NVC then the I-129 will go to the consulate and the I-130 will stay at NVC and they will send you paperwork about the IR-1 and CR-1 visas. You can tell NVC to cancel the I-130 because you are going the K-3 route or you can keep it there and hold off as a backup plan. They will keep it active for a year at NVC and will send you a notice of cancellation unless you let them know to keep it active. The choice is yours.

Steve/Jessica and Pushbrk, how does this work precisely, pursueing both routes to avoid making any mistakes)? So we let the I-129F go to the Consulate and run its course, submit all the paperwork and we go to the interview and get the visa. What if the I-130 is forwarded by NVC to the Consulate shortly afterwards, before I travel over? I go to another interview?

I imagined the visa would be placed in the passport. So it is possible to get both visas and then choose what you travel with?

And wont the Consulate make a problem of interviewing the same person for two different visas in a short time?

Let's say that the I-130 gets left behind at the NVC, and the I-129F gets sent to the Consulate, and if that happens can I request NVC to send the I-130 over or is decision really not mine at that point?

Second question I have is regarding the notification - will the consulate send me the notification that will let me know what petition(s) is being forwarded to the consulate or will the consulate notify me of the petition they actually received from NVC?

The I-130 documents won't be forwarded to the embassy/consulate until you've paid the Affidavit of Support and Immigrant Visa bill, AND subsequently sent the Affadavit of Support and DS-230 to the NVC.

My wife was approved March 25, NVC forwarded the K-3 to the embassy on April 29, and the K-3 interview was scheduled for May 27. She has her K-3 visa, but we continued on with the CR-1 to avoid the adjustment of status processing time, even though it requires going to the embassy for the interview. The K-3 will be forwarded to the embassy/consulate automatically, so your spouse will get a packet of information within a week or so of it being forwarded over.

We paid the NVC bills for the AOS/IV once our attorney received notification that the I-130 was processed at NVC, at the beginning of June. The documents were processed by NVC by June 19, and we got an interview date for the CR-1 in Tokyo scheduled for August 18.

So, even if both petitions are sent to the NVC, you'll likely find that the CR-1 still takes a bit longer to process than the K-3. But you'll definitely know the I-130 has been touched before it goes off to the embassy; you have to either give them money and the applications, or inform NVC that you want to go the adjustment of status route.

You need to read the step by step guide for CR1. Then you'll understand there are several steps requiring your interaction with NVC before the petition can be forwarded to the Consulate, including two fees you pay.
