Timeline

Understood this perfectly. Basically boils down to the government has the "monopoly" over "who-gets-in-and-who-does-not" and they create many many hoops (legal processes) for any rule-followers to jump through. It's #######, no doubt about it. Of course, you don't have to be a rule-follower and take a short cut, like using the VWP. However, you have to ask yourself the long and hard question: will you chance it?

After chatting almost daily online, exchanging emails (150+ in five months) and countless SMSes...

06/28/2007: Qifan flew to Shanghai :-)

07/04/2007: Met Annie's parents (very nervous)

2/6/2008: Received the NOA1

2/6/2008 - Present: Checking status and VJ timeline daily!

5/16/2008: Qifan flew to Shanghai :-) :-) :-)

5/18/2008: Dresses picking day (for photo shoot next day)

5/19/2008: Photo shoot day! Twelve hours long and 232 pictures taken

5/20/2008: Photo picking day... Ten hours long and 50 pictures selected

5/21/2008: Traveled to Putuo Mountain and prayed to the Goddesses

5/25/2008: Missed my flight and stole an extra day with Annie :-) :-) :-)

5/26/2008: Departing again :-( :-( :-(

6/16/2008: Received the NOA2!!!! Yipee!!

7/11/2008: NVC has received the case and assigned it with a GUZ #.

7/17/2008: NVC Rep. informed me the case has been forwarded to GUZ consulate.

Phone Record (from Jan 1st, 2008) $240.76 14104 min.

9/9/2008: Package received by GZ Consulate.

9/25/2008: P3 Received

10/6/2008: P3 Mailed

I believe that there is a max of 180 days one can visit the US in a year. You should figure out how many days he has been in the States since January. Then see how long he can visit for the next time.

There is no set amount of days allowed annually.

Basically, if you're living in the US more than you're living in your own country there is a problem.

That being said, entry is still always at the discretion of the POE officer. The first two visits were shorter but this last one was the full 90 days allowed on VWP(?) The officer must be convinced that he is going to return home.

You may get lucky. We did many times. But our luck ran out...

Timeline

My fiance came in November for a week (our first meeting in person) and then came back end of January for a month and then end of April for 3 weeks. This last trip we were definately worried that he wold be stopped because of things we had heard but he was asked less questions than before. Our lawyer said there shouldn't be a problem but I think it is who is working that day and what mood they are in.

Thanks everyone. He actually goes home July 1st, so he is three weeks short of the 90 days. I told him to wait about three weeks, then come back on a two week ticket...we can always change the return date after he gets here :)

Yeah, we got engaged during this trip...and actually talked about the VWP...but I don't feel comfortable with that.

Dave used the operative words "due to" which do not carry the same meaning as the word "after". What he's seen is people who are making multiple visits be denied for various reasons but not "due to" multiple visits. The reasons would be suspected immigrant intent or too much overall time in the US, as mentioned in other posts above.

There are people who cross the border from Canada or Mexico once or twice every week for years. Visiting isn't a problem. Immigrant intent is when no authorization to immigrate has been obtained.

Ummm yeah, that would have been a joke because obviously he missed reading my post and the fact that we are one of those couples denied entry. ;)

Yup, that's what happened to us! :yes: A + B = das boot!

Add multiple entry, more time in the US than not, no connections to 'home'...etc...etc... like I said, we were lucky to have the time together we did. ;)

TXLady--just to throw in a little practical suggestion. I sounds like you're in that wowee, I'm so in love, infatuated stage where you just can't stand being apart. If you want to do the immigration the safest, least risky way (K1) like you said, then it's going to take some months to do. He's spending a lot of money flying back and forth. If you could just stretch out the visits a little longer in between, it would probably make the whole process go smoother because waiting is part of the game. If they decide he's been too much and deny his entry to visit, then you're stuck with a big chunk of time apart while the petition is getting processed. So I guess I'm just suggesting pace yourself. Be sure and read everything at the top of the page under the blue tab called GUIDES and the one called VISA FAQ so you understand all that's required...the fees, the documents, the translations, the proof that you make enough to support him. The K1 flowchart is a good overall picture. It's in the Guide tab.
