No news from USCIS - its been two weeks

Hi Everyone,

Exactly two weeks ago we sent my husband's AOS application to the Chicago office. We sent it priority/certified mail, but still have not heard anything and our check has not been cashed yet. When I check the delivery status online, it says it was delivered on May 26th.

Should I be worried? Oh, I should also mention that today marks 90 days since he entered the US! Yikes!!!

Don't worry, your check will be cashed soon, some peoples checks were cashed one month after the sent their package, so i will say give it some more time.

30/01-2009:- I never thought I'd be typing this ---->10years green card received... USCIS, see you when I see you

Don't worry, some people's checks were cashed within 1-2 months.

10-Apr-08...Filing date for I-130/AOS/EAD/AP

02-May-08...Biometrics

31-Jul-08...EAD Card received

15-Sep-08...Interview (APPROVED)

27-Sep-08...GC received

03-Aug-10...Filed I-751 (Removal of Conditions)

06-Aug-10...NOA 1-yr Extension Letter

10-Sep-10...Biometrics

02-Dec-10...ROC approved! (Card production ordered)

Oh No!! We just got the rejection notice in the mail!!! Simply because we made the check out for the incorrect amount. We are already getting things together to resubmit tomorrow.... but here is the big problem.... Kelvin's I-94 expired yesterday. I hope he doesn't get rejected for a greencard. Will they take into consideration that we filed on time, but then had to resubmit - even if the mistake is our fault!

Please advise!! :unsure:

Don't worry!!! As long as your husband get married with you within 90 days here, he will be fine!! ;)

AOS Process:

- 11-28-07 I-485/I-765/I-131 sent

- 12-06-07 NOA1 of AOS

- 12-18-07 received RFE for I-864

- 12-20-07 EAD and AP touched (Notice Returned as Undeliverable)

- 01-04-08 Biometrics appointment done

- 01-19-08 resent hubby's income proof

- 01-28-08 AOS touched (Response to RFE received, and case processing has resumed)

- 03-10-08 EAD and AP finally touched and approved!!! =)

- 03-12-08 Case Transfer to CSC

- 03-13-08 EAD Touched again (Card Production ordered)

- 03-17-08 AP and Transfer notice received in mail (AP valids until 03-09-09)

- 03-18-08 EAD touched again (Approval Notice sent)

- 03-20-08 EAD received in mail

- 03-27-08 AOS Touched everyday since 03-20 (Case pending)

- 06-09-08 GC Card production ordered and welcome letter sent (6 months waiting!!!)

The requirement was that you MARRY within 90 days of his arrival, not filing for AOS. While they strongly encourage you to file before the I-94 expires, there is flexibility. Do not fret.

10/23/2006 - I-129F approved (97 days from CSC)

AOS

03/03/2007 - Married!

03/14/2007 - I-485 + I-765 sent

03/21/2007 - NOA1, Checks cashed

06/01/2007 - EAD card production e-mail received (74 days)

07/27/2007 - EAD RECEIVED (57 days after approval)

11/29/2007 - Infopass appointment - file was sent to a storage facility before it was finished processing.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Oh no! Now it's hopeless. Might as well buy Kelvin a ticket home right away. :jest::lol: hehehe Just kidding....

The critical deadline was getting married within 90 days after POE. Just get the AOS package with correct payment in the mail ASAP. Make sure you send it certified with return receipt, or some other trackab;e method such as FEDEX.

Check cashing can take upto a month or so...

Wrong check amount is no problem...in our case, the entire packet of stuff got sent back; we simply resubmitted with a new check. Piece of cake.

Yes, you are fine. You just need to get married within the 90 days. There is no deadline by which you need to apply for AOS. Some people actually wait quite a number of months, although it is in your best interests to file as soon as you can. Just redo the cheque in the correct amount and send in the package again. Make sure you send it back with a tracking number so you know when it arrives. Then, you just get to sit and wait. Good luck!
