Fiance is in France but from other country a few questions.

I am engaged to an Algerian and he lives in France, he is there without papers. I am wondering if that is an issue for us. I want to go there to marry him but is the fact that he is there without papers going to have an impact on us obtaining a visa for him? Is he going to be eligable to obtain a visa here still if he is there without a passport? What options do we have?

USCIS does concern themselves as to whether or not an intending immigrant is legally present in the country in which he/she resides. However, in order to obtain a visa to the US, the individual will need a current, valid passport.

I would encourage you to read the guides here to determine what is the best type of visa for you guys and to read up on bringing over an Algerian fiance/spouse. Individuals from some countries have a tougher time obtaining an immigrant visa. Its good to know what you may be up against. If you read in the Middle East / North Africa forum on this site you should find some helpful information.

The one certainty is that a current, valid passport is necessary.

US Consulate only place visas in passports. If he has no passport, there will be no visa of any kind.

And you most likely will have a difficult time getting an interview of any kind for him in Paris, as he is unable to prove "legal" ressidence in France....

The USA is not the only country with undocumented residents. Could be as simple as arrived on a fishing boat....

I agree with everything people stated above.

Moreover, i'm not sure exactly what the requirements are in order to get married in France, but if he is illegal, I doubt this would be simple.

07/31/08 Entry in USA with K1 visa

08/27/08 Married

05/15/09 Conditional green card received

05/10/11 Permanent green card received

07/28/12 Started naturalization process

08/31/12 Biometrics done

Hello,

USCIS asks also for the police records, Your fiance can't ask a police record in France.

And his adress for his interview?

Hi my husband is also from Algeria and living in Paris, but my husband is there legally on a visa. I suggest your ficance goes back to ALgeria, and that will cause less problems with the interview at the embassy. The U.S. embassy is great in Algeria, I kind of wish my husband was going to interview there. Oh its difficult for aliens to marry in France, My husband and I tried and tried, and it was one porblem after another. Even though he is there legally, and I'em a American, we still had problems. You have to as in your ficance case has to show residency in France and a whole mess of other docs to show he is there legally. Unless you have a lot of time and money, dont marry in France, especially if he is not there legally and gets caught there in France.
