we got this status on the i130

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Request for Additional Evidence Sent

On April 22, 2008, we mailed a notice requesting additional evidence or information in this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, call 1-800-375-5283 to update your address.

We haven't received the letter yet. I'm really worried. Can anyone who has been through the same thing help with how much it took until you actually got it in the mail??

Yeah the waiting is hell but at least they must be working on our petitions. Maybe they are getting to the approval stage and need something extra before they can finally do it. Dont know why, but we'll see what arrives in the post. Then hopefully they will approve the I-129f too so we can go with K-3. I have seen this happen to others. Just trying to be positive. Post onto this forum when you find out what they wanted.

Hi Dave,

I will post any news I have here. Although I have a feeling I know what's my RFE about. The lawyer my husband hired to assist us made a filling mistake on my husband's G325A (bio. data). I asked for copies and noticed that mistake. But then again it might not be that. I really hope that they'll approve the k-3. I so had it with these people!!!!

That would be great if you can post on this site when you find out, I will do the same. Gives us a good idea of the RFE timeframe. I dont think it holds us up for too long - it just seems like it right now as we are sick of waiting and days pass like weeks. Nice to know that your lawyer is working hard for their money! I too have a lawyer and hope that all is well. Then again a simple filing mistake can be easily and quickly resolved.

I'm sure you'll be fine and by the sounds of it approved soon. Good luck!

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

09/oct/2007 - I-129F Packet sent to CSC

10/oct/2007 - I-129F Packet received

12/oct/2007 - NOA1 receipt date

20/oct/2007 - NOA1 received

23/apr/2008 - APPROVED

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

I wouldn't worry until it hits 10-14 days. The sent April 22 bit does not mean it left the mailroom that day.

Hello!

We have finally received the Request for Evidence letter from USCIS. My husband called RFE line on Monday and explained that USCIS sent us a RFE letter of the 22nd of April, but it never arrived. The officer who he talked to said " I will fax the letter today". So she did , and we finally got it. Actually the lawyer we hired to help us got it and he did not even bother to call and anounce us that he received it.

Anyway, their request was for G325a ( both for my husband and me) , passport photos, and a copy of my birth certificate. Looks like we really have an inconmpetent lawyer who send the i130 file without these documents. We have prepared these docs and are ready to send them to USCIS. The thing is we have a problem. The lawyer did send some G325As, but in the i129f file. Those forms have mistakes on them and i'm afraid once they receive the new files they'll notice those mistakes and will drop our 129f, and only approve the i130.

The lawyer told my husband that we shouldn't send new, corrected G325As forms for the i129f as well, as those mistakes are minor and there are 2 different persons processing the files, so they won't notice. I do not trust that at all!!!

My husband called again RFE line and the lady he talked to said we should submit new g325a for the i129f file as well and attach a cover letter in which we explain why are we re-submitting them.

We are really mad at the lawyer right now. He did huge mistakes that delayed our process a lot. We hired him to help and we got more help from USCIS officers.

Fire the lawyer. The person at the RFE line advised you well. Petitions have been put together for joint adjudication now for a year and a half. That your lawyer doesn't know this does not speak well for him.

Facts are cheap...knowing how to use them is precious...

That really sucks about your lawyer. They get paid enough money so should know what they are doing. We have been lucky with our lawyer as they are pretty efficient. Anyway - I too had an rfe last week. Our lawyer got the paperwork on Monday and it was a request for a certified copy of our marriage certificate, we sent a photocopy of the original. Our lawyers office got the necessary paperwork inthe mail to Vermont on Monday so now we are waiting for touches or hopefully even the mythical 'approval'! I hope the I-129f gets approved. I dont get why so few are coming through Vermont right now when people have filed them and the whole idea is to bring spouses together sooner whilst the rest of the filing takes place. Please - approve my K-3!!!!!

Dave, when you got your RFE, was it showing in USCIS case line when you punch on your petition where it usually says case received and pending, etc, etc.???? And did they email you the RFE notification aslo???

Then when I went to the case status online to check my petition it said something like 'Request for Additional Information or Evidence Sent' instead of 'Case Received and Pending'. That was a week ago today that I received it so I am hoping for a quick turn around as we sent back the information they wanted 2 days ago. We'll see what happens.

Yeah I got an email from CRIS informing me of the rfe. Then when I went to the case status online to check my petition it said something like 'Request for Additional Information or Evidence Sent' instead of 'Case Received and Pending'. That was a week ago today that I received it so I am hoping for a quick turn around as we sent back the information they wanted 2 days ago. We'll see what happens.

Dave, thanks makes me feel better now. I sure hope a quick turn around for you. Keep fingers crossed, and dont give up the faith. Wishing you only the very best of luck on this journey.
