I-130 and K3 denied

Hi there!!

I am not a K3 applicant, I am going through my K1 process, but during my process I have met a friend, and we had our interview at the same day, she had her K3 denied, and she said to me that she had her I130 aproved, but as I don't know anything about K3 I can't help her... reading here this forum, I could notice that she could abandon her k3, it is a pity she didn't do this and went to the K3 interview instead...

well, now they are kind of lost in what to do and I would like to help them with some information, and I would like to know if someone here have already seen some similar situation, like being denied for K3...

yup.. need more info as to the reason of denial to move on.

Some confusions with dates :

1st : on her wedding certificate, because she booked their wedding in the court some days before he arrived in Brazil, and this date shows in the wedding certificate... 3 days before his arrival in Brazil

2nd: she had a tourist visa denied 5 months before meeting her future husband on line and started a relationship... so the Consul said he doesn't like coincidences like this ... in my opinion he thinks they have a fake relationship...

I know they are suffering a lot now, and they really love each other, it is because I am looking to information and wanting to help them... although I still have my own problems with my K1 to solve but would nice to gave them some information...

So was she asked for further evidence?

The first should be resolveable, the second may be more difficult but impossible to comment without full details.

I will ask them to post here... the Consul deliver her passport and said that they would investigate their case, sending again to US immigration... anyway, thanks for all responses, tomorrow I will ask them to come here, read and post more information...

1: Interesting that the USCIS didn't pick up on this when processing the petition. Seeing that the groom was not around on the date of the marriage, does the couple have a recognized marriage in accordance with the laws of Brazil? I would presume so if a certificate has been issued by a governmental authority. Perhaps a brief on the issue by a Brazilian attorney would resolve it.

2: Sounds like my wife's situation, I'm glad her interviewer didn't feel the same way.

Why was she denied????

Ask her, why is she denied? There are so many reasons why their denied. For instance, lack of documents and etc.

They got married before he arrived??

sounds a little strange to me

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

This is very strange because when your I-130 is approved then your I-129F should automatically be approved.

This is very strange because when your I-130 is approved then your I-129F should automatically be approved.

Mine wasn't, it took an additional 10 months to approve.

If what simoneandscott wrote is accurate then the I-129F was approved. There wouldn't have been a K3 visa interview if it wasn't.

I'll not comment on the issue of automatically approving an I-129F if an I-130 was approved except to say that given the intent of the legislation that created the K3 visa the I-129F should be denied if an I-130 has already been approved.
