I have entered the US on a K1 visa

i just want to make sure i have everything right! this may sould like a silly question but

is it ok to stay in the US after the 90 days as long as I have gotten married and have filed for AOS?

Don't worry... I have many qustions too :)... you are fine... if you married within 90 days you can stay as long as you wish :) but for your benefits (to work, travel etc) you need to send you AOS. For example we filed even when my I-94 and K-1 expired... but we married within 90 days... so we are fine :)

:yes: you are not required to have filed for AOS before the I-94 expires. It's best to do so as soon as you are able to file.

Make sure you file for AOS within 76 days upon entry of the US (14 days prior to the I-94 expiring). Good luck !!

If you get married on day 89 how can you possibly file for AOS by day 76? I think you meant to say be sure to file for your SSN within 76 days of entry...

I am sorry, but it is not right..... I called 1,000,000 times to USCIS and different people told me that I am OK even if my I-94 expired.... nothing about 14 days.... the most importnat is to marry within 90 days... you can stay in US after your I-94 expires as long as you wish (only if you married within 90 days)... look at me :) I applied 1.5 month after my I-94 expired... . but in order to live normal life (to work, to travel abroad and come back again to USA, to have your married name in driving license and SSN etc) you need to apply for AOS...

May be I am wrong, but this what USCIS and US Embassy people told me... Am I right??? :blink:

right, as long as you get married within 90 days of your arrival on a K1 visa you are fine. a lot of people have filed for aos after the I94 expired because of money problems but were approved.

its recommended to file for aos asap so you can work and travel!

My K1 visa expired in May 2007 and we just filed for AOS & EAD last month. Some people don't have the money to file right away, but it is a catch 22 since you can't work or travel out of the US with out the AOS & EAD. Keep watching my timeline as I do update it when I have news. As far as I know since I have rec'd my NOA1's for both that it is fine to file at a later date, but if they tell me different I will update my signature and timeline.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

NOA1's are simply a acknowledgement of receipt of an application.... Do not consider it as an aknowledgement of a properly filed or timely filed application.

You have to get married within 90 days. You can file for AOS anytime. You don't have to file within the 90 days, but don't wait forever because you don't have legal status and you won't get a Green Card until your AOS is approved.

Whatever you do, DO NOT leave the country until you have your Green Card!

This information is totally incorrect. You have 90 days to get married oncd you activate your K1 and then you file for AOS once you are ready. The sooner the better of course since all the 'perks' (work permit, SSN, travel permit,etc.) come after AOS.

This "apply on day 76" is misinformation.
